1386.03   COMPLIANCE REQUIRED; TEMPORARY PERMITS; FEE; OVERNIGHT STORAGE.
   (a)   Every person using a dangerous blasting ordnance in the City shall comply with this chapter, with applicable State and Federal laws, with the BOCA Basic Fire Prevention Code, as adopted in Section 1505.01, and with the National Fire Codes, in the use of such ordnance, including in the storage, transportation and safety practices. Such persons shall use every reasonable precaution to provide for the safety of all employees on the job and other persons who may be regularly entitled to be upon or near the explosive or dangerous blasting ordnance site, and shall provide for the safety of the general public. Every employee shall observe the provisions of this chapter, and no person shall use an explosive or dangerous blasting ordnance for blasting purposes in a manner contrary to this chapter.
   (b)   Upon application to the Director of Public Safety, and upon payment of the fee specified in subsection (c) hereof, a temporary permit shall be issued to a qualified applicant to acquire, possess, carry or use an explosive device or dangerous blasting ordnance, as follows:
      (1)   Contractors, wreckers, quarrymen, mine operators, landfill operators and other persons regularly employing explosives in the course of a legitimate business, with respect to explosives and explosive devices acquired, possessed, carried or used in the course of such business;
      (2)   Farmers, with respect to explosives and explosive devices acquired, possessed, carried or used for agricultural purposes as defined in Ohio R.C. 3743.01;
      (3)   Scientists, engineers and instructors, with respect to dangerous blasting ordnance acquired, possessed, carried or used in the course of bona fide research or instruction; and
      (4)   In the discretion of the Director, any reasonable person, with respect to dangerous blasting ordnance lawfully acquired, possessed, carried or used for a legitimate research, scientific, educational or industrial purpose, or other proper person.
   An application for a temporary permit under this subsection shall be in writing, under oath, to the Director.
   (c)   The application fee for a one-time temporary permit shall be twenty-five dollars ($25.00).
   (d)   Except where specifically permitted in writing by the Director or the Fire Chief, no person shall store any dangerous blasting ordnance overnight in the City.
