(a) Whoever violates or fails to comply with any provision of the Residential Code of Ohio is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000.00) or imprisoned not more than six months, or both, preempting and replacing any less severe penalty provisions in Section 109 of the Residential Code of Ohio. A separate offense shall be deemed committed each day during or on which a violation or non-compliance occurs or continues.
(b) The application of the above penalty shall not be held to prevent the removal of prohibited conditions.
