(a) No person shall operate or permit the operation of any tools or equipment in surface construction, drilling, building or demolition work between 11:00 p.m. and 7:00 a.m. of the following day, or on Sundays or holidays, except for emergency work of public service utilities. Permitted operations shall be in compliance with the following:
(1) Operations shall be conducted to minimize the impact of noise and dust to persons in the vicinity of the work.
(2) All surface equipment shall be equipped with noise and dust suppressors.
A. Equipment compressors shall be equipped with silencers on intake lines.
B. All gasoline or diesel-operated equipment shall be equipped with silencers or mufflers on intake exhaust lines.
(3) Storage bins and hoppers at surface construction sites shall be lined with materials that deaden sound.
(4) Spoil shall not be transported on streets between 7:00 p.m. and 7:00 a.m. of the following day.
(b) Whoever violates any of the provisions of this section is guilty of a misdemeanor of the second degree.
