(a) No person or contractor shall install a swimming pool under overhead electrical wires.
(b) Every pool installer or person who has been contacted to or has undertaken to install a swimming pool shall notify in writing a prospective pool purchaser of any dangers related to electrical wires located above the proposed location for the swimming pool and of the prohibition against installing a swimming pool under overhead electrical wires.
(c) After written notice has been given to a prospective pool purchaser, every pool installer or person who has been contacted to contract or undertake to install a swimming pool shall obtain a permit from the Building Department for the installation of the swimming pool, verifying that the swimming pool shall not be installed in violation of this provision and that written notice required in subsection (b) of this section has been provided.
(d) Notwithstanding Section 1501.99, if pool installation shall be commenced without the taking out of the necessary permit, pursuant to Section 185.04, a penalty in the amount of five hundred dollars ($500.00) shall be paid, and all work stopped until such time as such fee or fees have been paid and permits secured, to the satisfaction of the Commissioner.
