143.13   WORK WEEK; COMPENSATORY TIME OFF.
   (a)   As used in this section, "overtime" hours means those hours that members of the Division of Police, within rank, are actually employed over and above their regular hours of employment.
    (b)   The regular hours of employment for members of the Division of Police, within rank, are forty hours per week.
    (c)   Any and all members of the Division of Police, within rank, who presently have accumulated overtime, or who accumulate overtime in the future, shall, within a reasonable time thereafter, receive compensatory time off equal to such overtime hours worked.

    (d)   Notwithstanding the provisions of subsection (c) hereof, a member of the Division of Police, within rank, who, upon resignation, death or retirement from his or her position, has accumulated overtime due him or her, shall be paid for such accumulated overtime as follows:
      (1)   Overtime earned prior to
         September 8, 1981    -    at the salary rate in effect on the day of separation from employment; or
      (2)   Overtime earned from and
         after September 8, 1981    -    at the salary rate in effect when the overtime is earned.
