(a) Compliance with this chapter shall be monitored by the department. In addition, any peace officer may enforce the penal provisions of this chapter. The city manager may designate any number of additional individuals to monitor and facilitate compliance with this chapter.
(b) The department or other individuals designated to enforce the provisions of this chapter shall check each retailer at least once per twelve-month period to determine if the retailer is complying with all laws applicable to retailing, other than those laws regulating underage access to tobacco products. Nothing in this paragraph shall create a right of action in any retailer or other person against the city, the County of Santa Clara, or its agents.
