(B) Four copies of the preliminary plat and supplementary material specified shall be submitted to the Town Clerk with a written application for conditional approval at least seven days prior to the meeting at which it is to be considered. A filing fee in an amount on file in the Town Clerk’s office plus any extraordinary costs shall accompany the submission of the preliminary plat.
(C) Within 30 days following the review of the preliminary plat and other material submitted for conformity to this chapter and negotiations with the subdivider on changes deemed advisable and the kind and extent of improvements to be made by him or her, the Planning and Zoning Board shall state on the plat as submitted or modified their approval or disapproval. If approved, the Planning and Zoning Board shall express its approval in writing to the Town Council as conditional approval and state the conditions of the approval if any; or if disapproved, it shall express its disapproval and the reasons for disapproval to the Town Council in writing.
(D) The action of the Planning and Zoning Board shall be noted on four copies of the preliminary plat, referenced and not attached to any conditions determined. One copy shall be returned to the subdivider, two copies given to the Town Council, and the other retained by the Planning and Zoning Board.
(E) The Town Council will inform the subdivider of the approval or disapproval of the preliminary plat or conditional approval or disapproval of the preliminary plat and state the conditions of the approval or disapproval within two regular meetings thereafter or 30 days.
(F) Conditional approval of a preliminary plat shall not constitute approval of the final subdivision plat, but it shall be deemed an expression of approval of the layout submitted on the preliminary plat as a guide of the preparation of the final plat that will be submitted for approval by the Planning and Zoning Board and for recording upon fulfillment of the requirements of this chapter and the conditions of the conditional approval, if any.
