A. Misdemeanors: The doing of any act prohibited or declared to be unlawful or a misdemeanor by this code, or the omission or failure to perform any act or duty required by this code, unless another penalty is specified, shall be punishable by a fine in a sum not exceeding five hundred dollars ($500.00) for a misdemeanor or one thousand dollars ($1,000.00) for a serious misdemeanor, or imprisonment not to exceed thirty (30) days 1 .
B. Infractions: A municipal infraction is a civil offense punishable by a civil penalty of not more than seven hundred fifty dollars ($750.00) for each violation or if the infraction is a repeat offense, a civil penalty not to exceed one thousand dollars ($1,000.00) for each repeat offense. However, notwithstanding Iowa Code section 364.3, a municipal infraction arising from noncompliance with a pretreatment standard or requirement, referred to in 40 CFR section 403.8, by an industrial user may be punishable by a civil penalty of not more than one thousand dollars ($1,000.00) for each day a violation exists 2 .
C. Limitation; Compliance With Statute: The provisions of subsections A and B of this section notwithstanding, no penalty shall be greater than that established by state statute for the same offense. (2015 Code)
