§ 36.033 PUBLIC SAFETY SERVICE USER FEES.
   (A)   The city’s Volunteer Fire Department shall initiate user fees for the delivery of Department services, personnel, supplies and equipment to the scene of motor vehicle accidents. The rate of the user fees shall be that which is the usual, customary and reasonable costs (UCR), which includes any services, personnel, supplies and equipment and may fluctuate based on the needs of the accident.
   (B)   The user fees shall be initially filed to the motor vehicle insurance, representing an add-on-cost for the claim for damages of the vehicles, property and/or injuries. The claim costs shall be filed to the insurance company, the owner of a vehicle, owner of property or other responsible parties.
   (C)   The City Clerk-Treasurer may make rules or regulations, and from time to time may amend, revoke or add rules and regulations, not consistent with this section as they may deem necessary or expedient in respect to billing for these fees or the collection thereof.
   (D)   It is found and determined that all formal actions of this City Council concerning and relating to the adoption of this section were adopted in open meetings of this City Council, and that all deliberations of this City Council and any of its committees that resulted in such formal actions were in compliance with all legal requirements and the codified ordinances of the city.

MUNICIPAL PLANNING COMMISSION
§ 36.045 ESTABLISHMENT; JURISDICTION.
   This Commission shall be known as the Planning Commission. Upon the appointment and subsequent approval of members, election of officers and adoption of its bylaws, its existence shall begin subject to the provisions of KRS Chapter 100. The Commission may engage in planning operations within its jurisdiction which shall be coterminous with its political boundary except where otherwise provided for by KRS Chapter 100.

§ 36.046 MEMBERSHIP; ORGANIZATION.
   (A)   The Planning Commission shall consist of seven members. The Mayor, with the approval of the City Council, shall appoint all members. At least two-thirds of these members shall be citizen members who are not elected officials, appointed officials or public employees. One-third of the members may be members of city government or public employees.
   (B)   All government members of the Commission shall serve without compensation, but reimbursement of expenses may be authorized.
   (C)   The term of office of government members shall correspond to their respective official tenure. The term of office of citizen members shall be four years, except that original terms shall be staggered so that a proportionate number serve one, two, three and four years respectively.
   (D)   Reappointment or appointments to fill vacancies shall continue the staggered pattern. All vacancies whether by resignation, dismissal or expiration of the term of office shall be filled by the appropriate appointing authority or as otherwise provided for in KRS 100.147.
   (E)   The oath of office shall be administered to all members of the Commission before entering upon their duties. The oath shall be administered as provided by law. Any member may be removed by the appropriate appointing authority for inefficiency, neglect of duty, malfeasance or conflict of interest. The removed member shall have the right of appeal in the manner prescribed by law.
