There is hereby created a Shade Tree Commission which shall consist of the Director of Public Service, the Chairman of Council Streets Committee, and three citizens of this City who shall serve without compensation, and be appointed by the Mayor. The citizen members shall serve four year terms, and the Commission shall elect its own officers, shall make its own rules and regulations, shall keep a journal of its proceedings and shall require a quorum of all its members for the transaction of business. Vacancies in the Commission citizen membership, for any reason, shall be filled for the unexpired term in the same manner as original appointments are made, and the Mayor may remove any citizen’s members for failure to attend three consecutive regular meetings.

(a) The Commission shall have the authority to plan, study, investigate, report, advise and recommend to Council any program, action, plan or legislation which it finds or determines to be necessary or advisable for the conservation, care, planting, re-planting, trimming, removal or disposition of trees, plants and shrubs in the public ways, streets and alleys, and the Commission shall, when requested by Council, plan, study, consider, make findings, and report upon the special request so made. Conservation, care, planting, etc., also may be done in City parks and on private property, primarily to shade public sidewalks, provided that advance written permission is obtained from the private property owner as applicable.
(b) The Commission shall have the authority to apply for, receive, administer, and enter into agreements regarding grants and donations to be expended, after review and approval of the project by the Public Service Director, in accordance with the purposes set forth in this section by use of City forces or under contract with the City. All funds administered by the Commission shall be accounted for through the City Auditor’s office.
