§ 2.48.020 WATER DISTRICT REPRESENTATIVE.
   (A)   The nonelective Office of City Representative to the Elcar Water District is hereby created.
   (B)   The position shall not be a paid office.
   (C)   The appointee shall be required to take the oath of office as prescribed in § 228 of the Constitution of the commonwealth.
   (D)   No bond shall be required.
   (E)   The appointee shall reside within the city limits.
   (F)   The duties of the Representative shall be to:
      (1)    Attend Elcar Water District’s regular and special meetings;
      (2)   Participate in the decision making process of Elcar water and to vote in the best interest of the city; and
      (3)   Report to the City Council on a monthly basis as to the activities of Elcar water.
   (G)   The Representative of Elcar water can only be removed from office for misconduct, incapacity, or willful neglect and with approval of Council.
   (H)   In the event the Elcar Representative should move from the city limits, the Representative shall vacate the office immediately.
   (I)   In the event of removal or resignation of the Elcar Representative, a new Representative must be appointed within 30 days of the effective date of the resignation of the former Representative.
   (J)   Because of the time limits that have been placed on Elcar water and the city, this section is hereby declared an emergency.
