3-2-5: RETAIL SPIRITS STORES AND RETAIL STORES SELLING WINE OR BEER FOR OFF PREMISES CONSUMPTION:
   A.   Occupational Tax Levied: No person shall operate, manage or work in any retail establishment that sells, for off premises consumption only, any type of alcoholic beverage, as that term is found in 37 Oklahoma Statutes section 506 through September 30, 2018, and as found in 37A Oklahoma Statutes section 1-103 thereafter without having previously obtained an Occupational Tax permit for that store as provided in this chapter.
   B.   Retail Spirits, Retail Beer And Retail Wine Certificate Of Compliance:
      1.   A retail spirits, retail beer and retail wine certificate of compliance, on forms furnished by the City, shall be completed by every applicant for an original license pursuant to the Oklahoma Alcoholic Beverage Control Act.
      2.   This certificate shall be reviewed and approved by the following City departments:
         a.   The applicant's proposed location and use thereof must comply with all City zoning ordinances, verified by the Code Enforcement Officer, or his designee.
         b.   The applicant's proposed site and structure must comply with all Building Codes as required by this Code, verified by the Code Enforcement Officer, or his designee.
         c.   The applicant's proposed site, structure, and location must comply with all Fire Code requirements required by this Code, verified by the Code Enforcement Officer or his designee.
         d.   The applicant's proposed location and use thereof must comply with all provisions regarding food service requirements as required by this Code, verified by the Code Enforcement Officer or his designee.
   C.   Deliveries: No wholesale dealer in alcoholic beverages shall sell or deliver to any retail spirits store any alcoholic beverages on Saturdays, Sundays, New Year's Day, Memorial Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day, Christmas Day, or, while the polls are open on the day of any general, primary, runoff primary, or special election, whether national, State, County or City.
   D.   Employment: No person shall employ any person under eighteen (18) years of age in the selling of beer or wine or employ any person under twenty one (21) years of age in the selling of spirits.
   E.   Hours For Selling Alcoholic Beverages:
      1.   Retail Spirits Stores: Now and through September 30, 2018, no person shall open or operate a retail spirits store except between the hours of ten o'clock (10:00) A.M. and nine o'clock (9:00) P.M. Effective October 1, 2018, retail spirits stores will be permitted to remain open and operational from eight o'clock (8:00) A.M. through twelve o'clock (12:00) midnight. Further, no person shall open or operate a retail spirits store at any time on the following days:
         a.   Sunday;
         b.   New Year's Day;
         c.   Memorial Day;
         d.   Fourth of July;
         e.   Labor Day;
         f.   Veterans Day;
         g.   Thanksgiving Day;
         h.   Christmas Day; and
         i.   While the polls are open on the day of any general, primary, runoff primary or special election, whether national, State, County, or City.
      2.   Retail Beer Or Wine Stores: Effective October 1, 2018, a retail wine or retail beer establishment may offer wine or beer for retail sale on Monday through Sunday between the hours of six o'clock (6:00) A.M. and two o'clock (2:00) A.M. the following day.
   F.   Signs: No person shall erect or maintain any sign designating a retail liquor store unless they comply with the regulations set forth in title 10 of this Code. (Ord. 2018-4, 7-23-2018)
