ORDINANCE NO. 2023-5
AN ORDINANCE OF THE CITY OF OKEMAH, OKLAHOMA (THE “CITY”), AMENDING SECTIONS 9-1-1, 9-1-2, 9-1-3, 9-1-4, 9-1-6, 9-1-7, 9-1-9, 9-1-10, AND 9-1-11 OF THE CODE OF ORDINANCES RELATING TO THE ADOPTION OF THE 2021 EDITIONS OF THE INTERNATIONAL BUILDING CODE, THE INTERNATIONAL FIRE CODE, THE INTERNATIONAL RESIDENTIAL CODE, THE INTERNATIONAL PLUMBING CODE, THE INTERNATIONAL MECHANICAL CODE, THE INTERNATIONAL FUEL GAS CODE, THE INTERNATIONAL PROPERTY MAINTENANCE CODE, THE NATIONAL ELECTRICAL CODE, AND THE INTERNATIONAL EXISTING BUILDING CODE, WITH MODIFICATIONS, AS THE CODE OF THE CITY FOR REGULATING WITHIN THE LIMITS OF THE CITY OF OKEMAH; REPEALING ALL EXISTING ORDINANCES THAT CONFLICT HEREWITH; PROVIDING FOR THE CODIFICATION OF SAID AMENDMENTS AND NEW ORDINANCES; AND DECLARING AN EMERGENCY.
 
   BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OKEMAH, OKLAHOMA, AS FOLLOWS:
 
   Section 1.   That Section 9-1-1 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
 
   Section 9-1-1. BUILDING CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as The International Building Code, 2021 Edition (IBC 2021), as published by the International Code Council, Inc., and as adopted by the State of Oklahoma, acting through the Uniform Building Code Commission, be and hereby is adopted as the building code of the city for regulating and governing the conditions and maintenance of all property, buildings and structures by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use, and for the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said building code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with additions, insertions, deletions and changes, if any, as prescribed in Subsection B of this section.
 
   Section 2.   That Section 9-1-2 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
 
   SECTION 9-1-2. FIRE CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as The International Fire Code, 2021 Edition (IFC 2021), as published by the International Code Council, Inc., and as adopted by the State of Oklahoma, acting through the Uniform Building Code Commission, be and hereby is adopted as the code of the city for regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises in the city; providing for the issuance of permits for hazardous uses or operations; and each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with additions, insertions, deletions and changes, if any, as prescribed in Subsection B of this section.
 
   Section 3.   That Section 9-1-3 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
 
   SECTION 9-1-3. RESIDENTIAL CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as The International Residential Code, 2021 Edition (IRC 2021), as published by the International Code Council, Inc., and as adopted by the State of Oklahoma, acting through the Uniform Building Code Commission, be and hereby is adopted as the code of the city for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one- and two-family dwellings and townhouses not more than three (3) stories in height in the city; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with additions, insertions, deletions and changes, if any, as prescribed in Subsection B of this section.
 
   Section 4.   That Section 9-1-4 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
 
SECTION 9-1-4. PLUMBING CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as The International Plumbing Code, 2021 Edition (IPC 2021), as published by the International Code Council, Inc., and as adopted by the State of Oklahoma, acting through the Uniform Building Code Commission, be and hereby is adopted as the code of the city for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the city; providing for the issuance of permits and collections of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with additions, insertions, deletions and changes, if any, as prescribed in Subsection B of this section.
 
   Section 5.   That Section 9-1-6 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
 
SECTION 9-1-6. MECHANICAL CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as the International Mechanical Code, 2021 Edition (IMC 2021), as published by the International Code Council, Inc., and as adopted by the State of Oklahoma, acting through the Uniform Building Code Commission, be and hereby is adopted as the code of the city for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems in the city; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with additions, insertions, deletions and changes, if any, as prescribed in Subsection B of this section.
 
   Section 6.   That Section 9-1-7 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
 
SECTION 9-1-7. FUEL GAS CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as the International Fuel Gas Code, 2021 Edition (IFGC 2021), as published by the International Code Council, Inc., and as adopted by the State of Oklahoma, acting through the Uniform Building Code Commission, be and hereby is adopted as the code of the city for regulating and governing fuel gas systems and gas fired appliances as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with additions, insertions, deletions and changes, if any, as prescribed in Subsection B of this section.
 
   Section 7.   That Section 9-1-9 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
   
SECTION 9-1-9. PROPERTY MAINTENANCE CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as The International Property Maintenance Code, 2021 Edition (IPMC 2021), as published by the International Code Council, Inc, be and is hereby adopted as the Property Maintenance Code of the City of Okemah, in the State of Oklahoma for regulating and governing the conditions of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the City of Okemah are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Subsection B of this section.
 
   Section 8.   That Section 9-1-10 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
   
SECTION 9-1-10. ELECTRICAL CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as The National Electrical Code, 2011 Edition (NEC 2011), as published by the National Fire Protection Association, and as adopted by the State of Oklahoma, acting through the Uniform Building Code Commission, be and hereby is adopted as the code of the city for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to use or maintenance of electrical systems in the city; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section.
 
   Section 9.   That Section 9-1-11 of the Code of Ordinances for the City of Okemah is hereby amended to read as follows, to-wit:
 
SECTION 9-1-11. EXISTING BUILDING CODE.
 
A. That a certain document, a copy of which is on file in the office of the city clerk, being marked and designated as the International Existing Building Code, 2021 Edition (IEBC 2021), as published by the International Code Council, Inc., and as adopted by the State of Oklahoma, acting through the Uniform Building Code Commission, be and hereby is adopted as the code of the city for regulating and governing the repair, alteration, change of occupancy, addition and relocation of existing buildings, including historic buildings, as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with additions, insertions, deletions and changes, if any, as prescribed in Subsection B of this section.
 
   Section 10.   That all existing ordinances or parts of ordinances in conflict herewith are hereby repealed.
 
   Section 11.   That for the immediate preservation of the peace, health and safety of the City of Okemah and of the citizens and inhabitants thereof, an emergency is hereby declared to exist, and by reason whereof, it is necessary that this Ordinance shall go into full force and effect immediately upon its passage.
 
   PASSED AND APPROVED and the Emergency Clause voted upon separately and passed this 11 th day of December, 2023.
