ORDINANCE NO. 2021-9
AN ORDINANCE OF THE CITY OF OKEMAH, OKLAHOMA, AMENDING TITLE 8, CHAPTER 1, OF THE CITY CODE OF THE CITY OF OKEMAH, OKLAHOMA, BY ADDING SECTION 8-1-4, REQUIRING CONNECTION AND UTILIZATION OF CITY WATER, SEWER AND TRASH UTILITY SERVICES; REPEAL OF ALL CONFLICTING ORDINANCES; ALLOWING FOR CODIFICATION; AND ENACTING EMERGENCY CLAUSE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OKEMAH, OKLAHOMA:
SECTION 1. UTILIZATION OF CITY WATER, SEWER AND TRASH SERVICES:
Title 8 of the City Code of the City of Okemah, Oklahoma, is hereby amended by adding a new section, 8-1-4, Utilization of City Water, Sewer and Trash Services, to read as follows:
To assist in maintaining the general sanitation and health of the City of Okemah, all houses, buildings or properties used for human occupancy, employment, recreation or other purposes situated in the City of Okemah, shall connect and utilize the City of Okemah's water, sewer and trash (refuse) utility services. It shall be the duty of every person occupying or having control of the occupancy of any premises within the City of Okemah to notify the City of Okemah's Utilities Authority at the beginning of such occupancy and to request, accept and use the City's water, sewer and trash services. The failure of any owner, rental agent or occupant of such premises to make such request shall not prevent or in any way impair or impede the City of Okemah's Utlitiies Authority from adding the address of such premises to the records and providing such service and otherwise enforcing, the regulations approved by the City Council, and causing the fees or charges to be paid.
Any person who violates, neglects or refuses to comply with any regulation, requirement or provision of this section or any other regulation of the City Manager duly promulgated hereunder shall be deemed guilty of a misdemeanor with a fine of Five Hundred Dollars ($500.00) plus court costs.
SECTION 2: REPEAL OF ALL CONFLICTING ORDINANCES:
That should any provision of this Ordinance conflicting with any other Ordinance of the City of Okemah, the previous ordinance(s) are hereby repealed as to the conflicting provision(s) only.
SECTION 3: CODIFICATION:
This Ordinance shall be codified in the City of Okemah Code of Ordinances in Title 8, “WATER AND SANITARY SEWER SYSTEMS,” and numbered as Section 8-1-4.
SECTION 4: EMERGENCY CLAUSE :
It being necessary for the protection of the public peace and the health and safety of the citizens of Okemah, Oklahoma, an emergency is declared to exist and this ordinance shall become effective immediately upon its passage by the City Council.
PASSED AND APPROVED and the Emergency Clause voted upon separately and passed this 28th day of June, 2021.
