(A) There is hereby created the Department of Safety. The Mayor shall act as the Director of Safety and shall head the Department of Safety until the Council shall determine that the Office of Director of Safety shall be created with a person other than the Mayor to serve as the Director of Safety. The Mayor shall appoint any such separate Director of Safety, pursuant to Section 3.09 of this Charter, and the Director of Safety shall serve at the pleasure of the Mayor and the Council and may be removed by the Mayor and the Council without cause, as provided in Section 3.09 of this Charter. The Director of Safety shall be subject to the control, direction and supervision of the Mayor. The Department of Safety shall include the Divisions of Fire, Police and Building and Zoning inspection, and the heads of the Divisions of Fire, Police and Building and Zoning Inspection shall be subject to the control, direction and supervision of the Director of Safety.
(B) At the effective date of this Charter, the function of fire protection is provided by Hamilton and Madison Townships, and that arrangement is to be continued after the effective date of this Charter until it expires; subject to the power of the Council, from time to time, to provide for fire protection by contract or to create the Division of Fire to be headed by a Fire Chief who shall be appointed by the Mayor and the Council pursuant to Section 3.09 of this Charter and who shall be subject to control and direction by the Mayor until such time as a person other than the Mayor is appointed as the Director of Safety pursuant to this Charter.
(C) There is hereby created a Division of Police to be headed by a Police Chief who shall be appointed by the Mayor under Section 3.09 of this Charter and who shall be subject to control and direction by the Mayor until such time as a person other than the Mayor is appointed as the Director of Safety pursuant to this Charter.
(D) There is hereby created a Division of Inspection, to be headed by a Chief Inspector who shall be a person appointed by the Mayor under Section 3.09 of this Charter. The Chief Inspector may hold other office or position of employment with Obetz, other than Mayor, Council Member, Director of Law, Director of Finance or City Administrator or Village Administrator, as applicable. The Chief Inspector shall be subject to the control, direction and supervision of the Mayor until such time as a person other than the Mayor is appointed as the Director of Safety pursuant to this Charter. The Division of Inspection shall be responsible for the administration of Obetz’s ordinances and the laws of Ohio pertaining to building, zoning and housing codes.
(E) In the exercise of powers granted to the Council to create the Divisions of Police, Fire and Inspection by this Section, the Council shall act by ordinance.
