(A) The Department of Public Works shall be headed by the Mayor or the Administrator, if designated by the Mayor, until the Council, by ordinance, shall create a Director of Public Works. When a separate position of Director of Public Works is created, the Mayor shall appoint the Director of Public Works pursuant to Section 3.09 of this Charter, who shall serve at the pleasure of the Mayor and the Council and may be removed without cause by the Mayor and the Council pursuant to Section 3.09 of this Charter.
(B) The Department of Public Works shall consist of a Division of Utilities, a Division of Streets and other such Divisions or units as created, from time to time, by ordinance. The Mayor shall appoint the Superintendent of Utilities and Streets and the heads of other Divisions created by ordinance pursuant to Section 3.09 of this Charter, and all of whom shall serve at the pleasure of the Mayor and Council and may be removed without cause by the Mayor and the Council pursuant to Section 3.09 of this Charter. The Mayor shall direct and control the activities and work of the Department of Public Works with respect to Obetz’s utilities, including but not limited to water and sewer, and Obetz’s streets, highways and other public grounds. The Department of Public Works and the Divisions thereof shall have such powers, duties and functions as provided by the Charter, ordinance and the general laws of Ohio and as directed by the Mayor.
(C) The Director of Public Works and the Superintendent of Utilities and Streets shall be residents of or become residents of Obetz within six (6) months after their appointment unless Council shall waive the residency requirement by ordinance.
