1143.01 PURPOSE.
   The Multi-Family Residential District (M-12) is established as a high density multifamily district intended to allow renter and owner occupied properties in an apartment or condominium configuration at suitable locations with on-site amenities, such as recreational facilities and off- street parking. Such uses shall be serviced by public water and sanitary sewer systems.
1143.02 PERMITTED USES.
   (a)    Multi-family Residence. Multiple-unit residential structures not exceeding six (6) units per acre, including attached and detached condominiums and apartments unless approved as a part of a PRD.
   (b)    Public and Private Schools. Public or private schools offering general educational courses and having no rooms regularly used for housing or sleeping of students.
   (c)    Parks. Open spaces, playgrounds, and other related program elements and park features intended to provide for passive amenities to the immediate or surrounding neighborhoods, while limiting site impacts.

1143.03 ACCESSORY USES AND STRUCTURES. (REPEALED)
   EDITOR’S NOTE: Former Section 1143.03 was repealed by Ordinance 37-13.
1143.04 CONDITIONAL USES.
   (a)    Child Daycare Center. A kindergarten or a child daycare facility as an Accessory Use of a dwelling or as a Principal Use of the lot, provided there shall be an outdoor play area of 200 square feet or more per child. Such play area shall be arranged in accordance with the provisions of this district for Accessory Uses, and shall be enclosed with a sturdy and protective fence with a height of four feet, but not more than six feet. The building occupied by the use must be compatible with neighborhood structures in dimension, size, and architecture. A drop off area must be provided so that children do not have to walk through the parking lot to enter the facility.
   (b)    Family Homes. A Family Home, as defined in Section 1133.02, provided that the following standards and requirements are met:
      (1)    Submission requirements for family homes. In addition to the requirements of Chapter 1181 the applicant shall submit the following as a part of the Conditional Use permit application:
         A.    Information explaining the need for the facility, the clientele to be served and the resources that will be used to operate the facility.
         B.    Evidence that a valid license has been issued or is obtainable for the proposed facility.
         C.    Information on the nature of the care to be provided and the types of services to be offered.
         D.    Information on the estimated number of staff persons and clientele utilizing the facility.
      (2)    Performance standards.
         A.    No exterior alterations of the structure shall be made which depart from the residential character of the building.
         B.    No Family Home shall be located within 1,000 feet of another Family Home or Group Home, as defined by this Zoning Ordinance.
         C.    All requirements of Chapters 1167 and 1169 are met.
   (c)    Group Home. A Group Home, as defined in Section 1133.02, provided that the above requirements and performance standards for Family Homes are met.
   (d)    Churches and Other Similar Places of Worship and Parish Houses. Provided said use occupies a lot of not less than three (3) acres. The minimum lot width is three hundred (300) feet. The lot is adequate to accommodate the required off-street parking requirements of the church in accordance with Chapter 1169. The church building is set back from any adjacent residential property line a distance equal to or greater than the height of the structure exclusive of the steeple or spire. Accessory living quarters may be provided on the church lot as a conditional use. The location, density, and the additional lot area required for such uses shall be subject to approval by the Planning and Zoning Commission. Accessory recreational uses may be provided on the church lot as a conditional use subject to approval by the Planning and Zoning Commission.
   (e)    Assisted Living Facilities.
