§ 53.017 DISCONTINUANCE OF SERVICE FOR ENUMERATED REASONS.
   (A)   The utility reserves the right to discontinue the supply of water service and to discontinue its lines, or remove its property from the premises of the consumer for any of the following reasons or violations:
      (1)   For nonpayment of water bills, including any charges set forth under § 53.089.
      (2)   For nonpayment of sewage bills.
      (3)   For repairs to the utility's water system or unavoidable shortage or interruptions in the source of its supply.
      (4)   If the consumer's utilization of service is detrimental or hazardous to the service furnished by the utility to other consumers and if the consumer fails or refuses to correct the situation after reasonable notice has been given to the consumer by the utility.
      (5)   For any unsafe or objectional installations.
      (6)   When made incompatible, unreasonable or unlawful by the order of any state or federal government regulatory authority, laws of this state or any political subdivision thereof.
      (7)   If the property owner fails to sign an annexation petition as specified under § 53.003(C), Application For Service Outside Corporate Limits.
      (8)   If the consumer fails to comply with any of the rules and regulations set forth herein.
      (9)   When the consumer has moved from the premises or requested disconnection of service.
          (10)   To prevent fraud upon the utility or for fraud as defined in § 53.016.
          (11)   Willful destruction of any property or the utility located on the consumer's premises and if the consumer does not restore and/or pay for such property.
   (B)   Any such discontinuance or curtailment of service shall not terminate or reduce the term of any contract with the consumer nor abrogate any minimum charge specified therein.
   (C)   In the event that such a discontinuance of water involves an inhabited dwelling unit and the utility determines that such complete shut off of water will cause a sanitary or health problem in connection with the disposal of human waste, as an alternate to a complete shut off of water to an inhabited dwelling unit, the utility reserves the right to curtail if the water supply at the curb cock to the bare minimum water supply required to dispose of and discharge human waste into the utility's sanitary sewer. The minimum water flow shall be limited to an average flow of not more than one gallon per hour.
   (D)   All re-establishment of service is subject to the applicable turn-on, turn-off, trip and other charges as specified in § 53.089.
