1232.04 FINAL PLAT PROCEDURE.
   The following procedures shall be followed for a final plat for a major subdivision. (See Section 1232.05 for alternative Guaranteed Improvements and Delayed Recording Procedures.)
   (a)   Application. A subdivider desiring to create a major subdivision (for which Council approval of the preliminary plat is still effective) shall submit a complete final plat application (as provided in Section 1234.05) to the Director of Planning not less than 21 days prior to the regularly scheduled meeting at which it will be considered.
   (b)   Staff Review of Application. The Director of Planning shall transmit copies of the final plat application, or appropriate parts thereof, to the following City officials who shall advise the Planning Commission prior to the regularly scheduled meeting. (See Section 1232.06.)
      (1)   Director of Planning;
      (2)   City Engineer;
      (3)   Director of Building and Zoning;
      (4)   City Solicitor.
   The officials listed above shall confer with other officials and agencies as they deem necessary to provide information to the Commission relevant to review of the application. The Director of Planning shall transmit the original final plat application to the Clerk of Council.
   (c)   Planning Commission Review and Action. The Planning Commission shall, within 60 days (or for an additional period of not more than 60 days if agreed with the subdivider) after the first regularly scheduled meeting at which the application is considered, review the application and any information provided by the Director of Planning, City Engineer, City Solicitor, and other reviewers, and take action to either:
      (1)   Make a recommendation to City Council to approve or conditionally approve the final plat. If the Commission recommends approval, the recommendation shall be forwarded to the Clerk of Council within three days. A recommendation of approval of the final plat may be subject to conditions requiring completion and execution of required documents; or
      (2)   Disapprove the final plat. If the Commission disapproves the final plat, written notice, including a statement of the reasons for disapproval, shall be delivered to the subdivider. Subsequent to disapproval, the subdivider may, within not more than 30 days, make the necessary corrections and resubmit the final plat for approval.
   If the Planning Commission disapproves the application, or does not make a recommendation to Council within the period of 60 days (or 120 days as stated above), the application shall be deemed to be disapproved. If the final plat application is disapproved or no recommendation is made, appeal shall only be made to a court of competent jurisdiction.
   (d)   Council Review and Action.
      (1)   City Council shall, not later than 30 days after receipt of the recommendation of the Planning Commission (or for an additional period of not more than 30 days if agreed with the subdivider), take action to approve, approve with conditions, or disapprove the final plat.
      (2)   If Council disapproves the final plat, written notice, including a statement of the reasons for disapproval, shall be delivered to the subdivider. Subsequent to disapproval, the subdivider shall be required to submit a new application for final plat in order to proceed with subdivision.
      (3)   If Council does not take action to approve or disapprove the application within 30 days (or within 60 days as in division (d)(1) of this section), the application shall be deemed to be disapproved.
   (e)   Effect of Council Approval. Council approval of the final plat authorizes the City officials listed in Section 1234.05 to sign the final plat and authorize the Director of Planning to release the final plat for recording subsequent to satisfactory completion of all actions required by these Regulations to ensure the construction of improvements and dedication of public rights-of-way and other properties.
