1232.05 SIGNING AND RECORDING OF FINAL PLAT; GUARANTEED IMPROVEMENTS PROCEDURE; DELAYED RECORDING PROCEDURE; REVISIONS.
   The subdivider may proceed with either the Guaranteed Improvements Procedure or the Delayed Recording Procedure as provided in division (b) and (c) of this section.
   (a)   Transmittal for Signatures. As provided in division (b) or (c) of this section, as applicable, the subdivider shall submit the final plat (complying with all requirements of Council's approval and in form as required for filing by the County Recorder) to the Director of Planning who shall present the plat to the required City officials for Signature. The Clerk of Council, is hereby designated and authorized to issue certification as to the approval of a subdivision of land, subsequent to final approval of the subdivision by the City Council and subsequent to signature by the Mayor, the Clerk of Council, the City Engineer and the Chairperson of the Planning Commission.
   (b)   Guaranteed Improvements Procedure. If the subdivider determines to proceed with the Guaranteed Improvements Procedure, then the subdivider shall provide performance guarantees as required by these Regulations whereupon the Director of Planning, with concurrence of the City Engineer and City Solicitor, shall present the plat to the required City officials for signature and shall release the signed plat to the subdivider for recording. The Director shall retain one copy of the signed, released plat for City records.
   (c)   Delayed Recording Procedure. If the subdivider determines to proceed with the Delayed Recording Procedure, then the subdivider shall carry out construction, inspection, testing, maintenance, dedication and acceptance procedures as provided by these Regulations. After City Council accepts the required improvements and authorizes the recording of the final plat, the Director of Planning, with concurrence of the City Engineer and City Solicitor, shall present the plat to the required City officials for signature and shall release the signed plat to the subdivider for recording. The Director shall retain one copy of the signed, released plat for City records.
   (d)   The subdivider shall submit the signed, released final plat to the County Recorder for recording within two years after Council approval or the approval shall lapse and the subdivider shall be required to submit a new application for final plat in order to proceed with subdivision.
   (e)   No plat of any major or minor subdivision shall be recorded in the County Recorder's office or have any validity until approved in the manner prescribed in these Regulations. In the event any unapproved plat is recorded, it shall be considered invalid and the City Council shall institute proceedings to have the plat stricken from the records of Summit County, Ohio.
   (f)   Revision of Final Plat.
      (1)   No change, erasure, modification, or revision shall be made in any final plat after approval of the final plat by City Council unless the plat is resubmitted to the Planning Commission and City Council.
      (2)   The Planning Commission shall make a recommendation to City Council regarding any change in the final plat proposed by the subdivider. City Council shall take action to approve or deny the change.
