1042.02 TAP-IN FEE FOR BARBER ROAD SANITARY SEWER.
   The lots and lands described by parcel number in Exhibit A attached to original Ordinance 51-1999, passed September 13, 1999, and incorporated herein by reference, which may be separately benefitted at some time hence by any means, including separate ownership from adjacent lands and/or separate development requiring separate connection to the Barber Road Sanitary Sewer, and the owner or owners thereof, shall be charged and shall pay a tap-in fee in the amount of fifteen thousand dollars ($15,000) upon separate connection of facilities (located on or through such parcel) to the Barber Road Sanitary Sewer, as constructed pursuant to Resolution 45-1999, passed August 23, 1999.

1042.03 CONNECTION TO SANITARY SEWER REQUIRED. (REPEALED)

1042.04 FEES FOR CONNECTION TO BRENTWOOD WASTEWATER TREATMENT PLANT SEWER BENEFITS.
   The Director of Public Service is hereby authorized to sell permits for the remaining sewer benefits at the Brentwood Wastewater Treatment Plant within the service area identified on the map attached to original Ordinance 114-2003, passed December 29, 2003, known as the Loyal Oak Sewer Extension Project area, at the following charges:
   (a)   The current capacity fee is one thousand six hundred dollars ($1,600.00) per benefit at 400 gallons of estimated flow per day, as flow is estimated in the Ohio EPA's suggested sewage flow guide. Such per benefit fee shall increase annually by three percent beginning on January 1, 2004:

   (d)   All sewer lines and connections shall be constructed in accordance with the City of Norton's standards, and the use(s) and/or expansion of use(s) on the property shall not be permitted to exceed the capacity of 400 gallons per day, as calculated under the EPA estimated flow guidelines, without the payment for additional benefits usage.

1042.05 ACCESS CHARGES FOR NEW CONNECTIONS. (REPEALED)

1042.06 SURCHARGES FOR CONNECTION TO SANITARY SEWER SYSTEM. (REPEALED)

1042.07 UNPAID ACCOUNTS.
   Any delinquent or uncollectable sewer account balance or benefit charge owed the City shall be entered upon the tax duplicate, shall be a lien upon such lands from the date of the entry and shall be collected as other taxes and returned to the appropriate sewer fund. When the Director of Public Service determines that a sewer customer's account is delinquent or uncollectable, the Director of Public Service shall make a written return to the County Fiscal Officer of the amount delinquent or uncollectable upon the account address location.

1042.08   BENEFIT CHARGES FOR SPECIFIC IMPROVEMENTS.
   The following specific benefit charges for specific improvements are hereby established.
   (a)   In addition to any other fees payable under this Chapter 1042, the following benefit charges shall be paid by any property that accesses or connects to the following improvements:
      (1)   A benefit charge in the amount of sixteen thousand five hundred dollars ($16,500) per benefit for any property or person that accesses or connects to the sanitary sewer installed as part of the Cleveland-Massillon Road Sanitary Sewer Phase I Project. Commencing in 2022 and for six years thereafter, the benefit charge for such Project shall increase by five hundred dollars ($500.00) per year in accordance with the following schedule:

      (2)   A benefit charge in the amount of thirteen thousand five hundred dollars ($13,500) per benefit for any property or person that accesses or connects to the sanitary sewer installed as part of the Nash Heights Gravity Sanitary Sewer System Improvements. Commencing in 2022 and for four years thereafter, the benefit charge for such Project shall increase by five hundred dollars ($500.00) per year in accordance with the following schedule:

      (3)   A benefit charge in the amount of thirteen thousand seven hundred dollars ($13,700) per benefit for any property or person that accesses or connects to the sanitary sewer installed as part of the Cleveland-Massillon Water and Sanitary Sewer Extension Project. Commencing in 2022 and for nine years thereafter, the benefit charge for such Project shall increase by five hundred dollars ($500.00) per year in accordance with the following schedule:

      (4)   A benefit charge in the amount of fourteen thousand five hundred dollars ($14,500) per benefit for any property or person that accesses or connects to the sanitary sewer installed as part of the Cleveland-Massillon Road Phase 3 Sanitary Sewer Extension Project. Commencing in 2023 and for nine years thereafter, the benefit charge for such Project shall increase by five hundred dollars ($500.00) per year in accordance with the following schedule:

         For purposes of calculating the benefit charge in this section, a single "benefit" is defined as 400 gallons or less of wastewater emitted from the site per day. The number of benefits per property owner shall be based on the number of gallons of wastewater anticipated, as determined by standard gallon per day flow rates established by the Environmental Protection Agency. No charge will be for less than one full benefit.
   (b)   Any property or owner that accesses or connect to any of the improvements described in this section and is charged a benefit charge in accordance with subsection (a) above may pay the benefit charge in full at the time of the tap-in or may select to pay monthly installments as part of a payment plan ("payment plan"). The Administrative Officer of the City must approve all payments plans on behalf of the City and may require the consumer to execute and deliver to the City a promissory note in the amount owed for the benefit charge. In no case shall a payment plan be for a term exceeding ten years or 120 monthly instalhnents for commercial or industrial properties or twenty years or 240 monthly installments for residential properties. The number of installments shall be selected by the consumer initially and may not be changed once approved by the Administrative Officer. If a payment plan is selected and approved by the Administrative Officer, the first installment shall be due when the tap-in permit is issued. Subsequent installments shall be due with the payment of the monthly water bill. Installments shall include equal payments of the principal amount of the benefit charge, plus interest accrued thereon at the rate of interest paid by the City for the financing of the improvement.
   (c)   In the event that any property or person is connected directly or indirectly to the sanitary sewer improvements described in this section in violation of any of the provisions of this section, and the owner, agent, lessee, tenant or occupant of such property fails or refuses to disconnect the same upon being directed to do so by the City, the City Engineer is hereby authorized to cause such lot or land to be disconnected from the sanitary sewer system, and the violator shall be liable to the City for the cost of making such disconnection.

1042.99 PENALTY.
   Whoever violates or fails to comply with any of the provisions of Section 1042.03 is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
