ORDINANCE NO. 2017-3
AN ORDINANCE OF THE BOARD OF ALDERMEN OF NORTH TOPSAIL BEACH, NORTH CAROLINA, ENACTING A UNIFIED DEVELOPMENT ORDINANCE FOR THE TOWN OF NORTH TOPSAIL BEACH, NORTH CAROLINA, REVISING, AMENDING, RESTATING, CODIFYING AND COMPILING CERTAIN EXISTING DEVELOPMENT ORDINANCES OF THE TOWN DEALING WITH SUBJECTS EMBRACED IN SUCH UNIFIED DEVELOPMENT ORDINANCE
WHEREAS, Sections 160A-77 and 160A-78 of the North Carolina General Statutes require municipalities to maintain a code of ordinances; and
WHEREAS, the Town of North Topsail Beach has entered into a contract with American Legal Publishing to properly organize and index the Town's Unified Development Ordinance; and
WHEREAS, it is necessary for the Town Board to adopt the newly organized and indexed Unified Development Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF NORTH TOPSAIL BEACH, NORTH CAROLINA, this 3rd day of May 2017, that the ordinances of the Town of North Topsail Beach as revised, amended, restated, codified and complied in book form are hereby adopted as and shall constitute the "Unified Development Ordinances for the Town of North Topsail Beach, North Carolina"; and
BE IT FURTHER ORDAINED, that such Unified Development Ordinance as adopted shall consist of the following titles: General Provisions, Administration, Zoning, Use Regulations, Dimensional Requirements, Development Standards, Flood Damage Prevention, Signs, Nonconformities, Enforcement, and Definitions; and
BE IT FURTHER ORDAINED, that all prior ordinances pertaining to the subjects treated in the Unified Development Ordinance shall be deemed repealed from and after the effective date of this ordinance except as they are included and reordained in whole or in part in such Unified Development Ordinance; provided, such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this ordinance, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Unified Development Ordinance.
This ordinance shall be effective upon its adoption.
