1492.12 INSPECTION OF RIPARIAN SETBACK AND WETLAND SETBACK.
   (a)   The riparian setback and wetland setback shall be inspected by the City or by the Cuyahoga SWCD:
      (1)   When a preliminary subdivision plat or other land development plan is submitted to the City.
      (2)   When a building or zoning permit is requested.
      (3)   Prior to any soil-disturbing activity to inspect the delineation of the setback as required under these regulations. The applicant or his or her designated representative shall provide the City with at least five working days notice prior to starting soil-disturbing or land-clearing activities. A videotape record is required to be performed and submitted.
      (4)   When dedication of a subdivision is requested.
   (b)   The riparian setback shall also be inspected annually or as the time permits by the City or approved monitoring entity for compliance with any approvals under these regulations or at any time evidence is brought to the attention of the City that uses or structures are occurring that may reasonably be expected to violate the provisions of these regulations.
    (c)   Violations of these regulations will be handled as noted in Section 1492.02(d).
