(a) The provisions of this chapter shall apply to all lands within the corporate limits of the City except as described in subsection (b) hereof.
(b) The provisions of this chapter shall not apply to any parcel of land that is included in a subdivision that has previously received record plat approval or has been dedicated by the City or is property that has been developed before the effective date of this chapter, except that new or expanded uses or structures within the riparian or wetland zones or their respective setbacks, as permitted by the City, shall require the execution of a Chapter 1492 Release and Waiver form by the applicant.
(c) No preliminary plan or building permits shall be issued by the City without full compliance with the terms of these regulations.
(d) Any person or organization who violates any provision in this chapter shall be guilty of a minor misdemeanor and, upon conviction thereof, shall be subject to punishment as provided in Section 1492.99, and shall be required to restore the riparian or wetland setback through a plan approved by Cuyahoga SWCD.
(e) The provisions of this chapter may be enforced through civil or criminal proceedings brought by the City of North Royalton Law Director on behalf of the City of North Royalton.
