848.02 CHRISTMAS TREE SALES; PERMIT REQUIRED; FEE; BOND, INSURANCE, AND EXEMPTED ORGANIZATIONS.
   Whoever desires to sell Christmas trees within the City during the Christmas season shall file with the Building Inspector a written application for a permit, which application shall set forth the following items:
   (a)   The proposed period of time within which such trees will be sold.
   (b)   The location of the site.
   (c)   The name of the owner of the site.
   (d)   Statement that the site is located within a Local Business, General Business or Public Facility zone.
   (e)   The applicant shall also state he will not locate such trees closer than twenty-five feet from the curb.
   (f)   He will post not more than one two-sided temporary sign advertising the sale of such trees, such sign to be a size not greater than sixteen square feet and the sign will not be placed nearer than twenty five feet from any curb.
   (g)   The site will be adequately lighted.
   (h)   Adequate off-street parking will be maintained.
   The fee for such permit will be two hundred dollars ($200.00), as provided for in Chapter 214.05 of the Codified Ordinances of North Royalton, which will be payable with the application. In addition thereto, the applicant shall post a one hundred dollar ($100.00) cash bond to guarantee that the site will be cleaned up within ten days after December 25. In the event that the applicant should fail to clean up the site within that time, the one hundred dollars ($100.00) cash bond will be forfeited. The applicant will also provide a certificate of insurance showing coverage of public liability insurance with limits of one hundred thousand dollars ($100,000) for personal injury and fifty thousand dollars ($50,000) for property damages.
   This chapter shall not apply to permanently established nurseries located within the City.
   Bona fide charitable organizations shall not be required to pay for the permit provided for in Section 848.02, but in all other respects such organizations shall be subject to the terms of this chapter.
