(a) No person shall maintain, conduct, promote or operate on any land, premises or picnic grove within the City, other than in established theaters or auditoriums licensed or permitted for public occupancy according to law, any mass musical or public entertainment, however referred to or designated, including, but not limited to, "pop festival," "rock music festival," "rock festival," "jazz festival," "rock and roll music festival" or any combination thereof, except pursuant to a special permit issued by a two-thirds affirmative vote of Council as is hereinafter provided.
(b) No person having any right to or interest in any real property within the jurisdiction of the City shall license, rent, lease or otherwise permit the use of such real property or any part thereof for any mass musical or public entertainment, as provided in subsection (a) hereof, other than in established theaters or auditoriums licensed or permitted for public occupancy, according to law, except pursuant to a special permit issued by Council.
