121.01 MEETINGS.
   (a)   The regular meeting of Council shall be scheduled and held on the first Tuesday of each month, except the months of January, July, August and September, at 6:00 PM in Council Chambers located at 3801 Harvard Avenue, Newburgh Heights, Ohio 44105.
   (b)   The regular meeting of Council during the months of January, July and September shall be scheduled and held on the third Tuesday of said months, at 6:00 PM in Council Chambers located at 3801 Harvard Avenue, Newburgh Heights, Ohio 44105.
   (c)   The regular meeting of Council shall not be scheduled or held during the month of August each year.
   (d)   Council reserves the right to cancel or move its regularly scheduled November Council meeting to the third Tuesday of the month in years in which the regularly scheduled meeting would fall on an election day.
   (e)   Provided proper legal notice is given, and provided further that the Village complies with all applicable provisions of Section 121.22 of the Ohio Revised Code, Council may open any regularly scheduled Council Meeting at any time prior to 6:00 p.m., pursuant to proper notice and subject to the following conditions:
      (1)   An Executive Session has been scheduled for the Meeting;
      (2)   Council immediately goes into Executive Session pursuant to roll call vote and for permissible purposes under Ohio law; and
      (3)   At the conclusion of the Executive Session, Council shall remain in recess until at least 6:00 p.m., at which time Council may commence with conducting the remainder of its regularly scheduled meeting.

121.02 HIRING AND FIRING OF EMPLOYEES.
   (a)   Effective upon the passage of this section, the hiring of all full-time and part-time employees shall be effectuated in accordance with Ohio law and as follows:
      (1)   All employees, pursuant to this section, shall be hired by appointment of the Mayor with the consent and approval of a majority of the full Council.
      (2)   Each prospective employee (except juveniles desirous of seeking employment through the Summer Works Program funded by the Village Community Development Block Grant) shall be interviewed by both the Mayor and Council.
   (b)   Effective upon passage of this section, the termination of any full-time or part-time employee shall be effectuated in accordance with applicable Ohio law.

121.03 PHYSICAL EXAMINATIONS FOR EMPLOYEES ON EXTENDED MEDICAL OR DISABILITY LEAVE.
   (a)   Upon the passage of this section, all employees of the Village on an extended medical, maternity or disability leave of absence shall, within thirty days of communicating in writing an intention to return to work, submit to, and pass a physical examination, including a physical capacity evaluation, conducted by a physician licensed and certified by the State of Ohio.
   (b)   “Extended medical or disability leave” shall be construed and defined as that period of time commencing six months after the employee’s last day worked.
   (c)   The licensed physician conducting the physical examination shall be chosen by the majority of the members of Council. The cost for the employee’s physical examination shall be borne by the Village.
   (d)   The failure of any employee to comply with the provisions of this chapter may subject such employee to discipline and/or discharge pursuant to Ohio R.C. 737.1711.
