§ 72.05 OVERWEIGHT VEHICLES.
   (A)   A vehicle which would otherwise be a prohibited vehicle pursuant to § 72.04(A) shall not be a prohibited vehicle if such vehicle meets the requirements of this section.
   (B)   Any otherwise prohibited vehicle, whose declared gross vehicle weight is 27,000 pounds or less, may acquire an annual permit from the purposes of using the town’s streets. Upon issuance of such permit, such vehicle shall be excluded from the definition of prohibited vehicle during the life of the permit.
   (C)   The permit referenced in division (B) above shall be issued for an annual period of 12 months and must be displayed prominently in the cab of the vehicle while the vehicle is in the corporate limits of the town, and, shall be displayed to any police officer upon request.
   (D)   Failure to display the permit as required in this section shall automatically be deemed a revocation of the permit and shall subject the operator of the vehicle to the penalties provided for operating a prohibited vehicle in the town.
   (E)   The fee for the permit provided for in this section shall be $1 per 100 pounds of declared gross vehicle weight of such vehicle above 11,000 pounds, which permit fee shall be deposited to the General Fund of the town.
   (F)   (1)   Permits shall be issued to a vehicle based upon the vehicle identification number and no permit shall be transferable from one vehicle to another except upon application to the Board of Metropolitan Police Commissioners for such transfer and the payment of a $25 transfer fee. Transfer of a permit does not extend its period of validity.
      (2)   Any vehicle displaying a permit not issued to it shall be deemed a prohibited vehicle and subject to the penalties for operation as such prohibited vehicle on the town’s streets.
   (G)   Permits shall be issued by the Town Police Department upon the inspection of the vehicle and approval of the application by the Police Department and payment of the fee to the Clerk-Treasurer. The application for permit, and the permit itself, shall be in the form prescribed by the Board of Metropolitan Police Commissioners.
