ADOPTING ORDINANCE
ORDINANCE 2016-12
AN ORDINANCE ADOPTING THE TOWN OF NEWBURGH, INDIANA, CODE OF ORDINANCES
WHEREAS, Indiana Code Section 36-1-5-3 mandates that the legislative body of every City, Town and County codify all of their ordinances which are of a general and permanent nature; and
WHEREAS, the last codification of the ordinances of the Town of Newburgh was completed and adopted by the Town Council in the yearl991; and
WHEREAS, the Newburgh Town Council has employed American Legal Publishing Corporation to update and re-codify the 1991 code of the Town of Newburgh so as to include ordinances adopted by the Town Council up to and including December 31,2015; and
WHEREAS, American Legal Publishing Corporation has prepared and submitted a proposed code of ordinances to the Town Council; and
WHEREAS, the Town Council desires to adopt the code of ordinances presented by American Legal Publishing Corporation.
BE IT THEREFORE ORDAINED:
   SECTION 1. The Town Council hereby adopts the Town of Newburgh, Indiana, Code of Ordinances prepared for the Town by American Legal Publishing Corporation and covering the period up to and including December 31, 2015, which code of ordinance is hereby incorporated by reference.
   SECTION 2. The Code of Ordinances, as adopted in Section 1, shall consist of the following Titles:
   Title I:      General Provisions
   Title HI:   Administration
   Title V:   Public Works
   Title VII:   Traffic Code
   Title IX:   General Regulations
   Title XI:   Business Regulations
   Title XIII:   General Offenses
   Title XV:   Land Usage
   SECTION 3. All provisions of the Code of Ordinances shall be in full force and effect following publication of this Ordinance, and all ordinances of a general and permanent nature of the Town of Newburgh, Indiana, enacted on final passage on or December 31, 2016, and not incorporated in this Code or recognized and continued in force by reference therein are hereby repealed from and after the effective date of this Ordinance, except as herein provided.
   SECTION 4. The repeal provided for in Section 2 shall not affect any offense or act committed or done or any penalty or forfeiture incurred or imposed before the effective date of this Ordinance; nor shall such repeal be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this Ordinance; nor shall such repeal affect any ordinance or resolution promising or guaranteeing the payment of money for the Town, or authorizing the issuance of any bonds of the Town or any evidence of the Town's indebtedness, or any contract or obligation assumed by the Town; nor shall such repeal affect the administrative ordinances or resolution not in conflict or inconsistent with the provisions of the Code; nor shall such repeal affect any right of franchise granted by any ordinance or resolution of the Town Council to any person, firm or corporation; nor shall such repeal affect any ordinance establishing a regulated sewer or water territory; nor shall such repeal affect any ordinance dedicating, naming, establishing, locating, relocating, opening, closing, paving, widening or establishing grades of any street or public way in the Town; nor shall such repeal affect any ordinance levying or imposing taxes not included herein; nor shall such repeal affect any ordinance or resolution relating to salaries of Town employees; nor shall such repeal affect any ordinance providing for local improvements and levying special assessments therefore, nor shall such repeal affect any ordinance dedicating or accepting any plat or annexing territory into the Town; nor shall such repeal affect any ordinance or resolution establishing, re-establishing or modifying the boundaries of any zoning districts or changing the zoning classification of any lot or parcel of land; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Code.
   SECTION 5. Two copies of the Code of Ordinances shall be kept on file in the office of the Clerk-Treasurer of the Town of Newburgh, Indiana, for public inspection and use.
This Ordinance shall be in full force and effect from and after its passage by the Town Council of the Town of Newburgh, Indiana.
