1860.07 STANDARDS FOR VEHICLES USED IN SOLID WASTE ENTERPRISES; INSPECTIONS; DECALS.
   (a)   No person shall employ, cause to be employed or permit the use of a vehicle for the purpose of hauling or otherwise transporting solid waste in furtherance of, incident to or for the purpose of conducting a solid waste enterprise, unless such vehicle meets the following minimum requirements:
      (1)   The vehicle shall be safe and equipped as required by law, its equipment shall be in proper adjustment or repair and it shall be in compliance with the equipment provisions of Ohio R.C. Chapter 4513 and these Codified Ordinances.
      (2)   Any device, feature, structure, mechanism or container upon such vehicle, the purpose of which is to carry or confine the solid waste to be hauled or otherwise transported, shall be sealed or securely covered with a tarpaulin to prevent the contents thereof from being blown from the vehicle or container, and shall, in addition, be so constructed as to prevent any of its contents from dropping, sifting, leaking, being blown out of or otherwise escaping therefrom.
   (b)   The Director of Public Service, or his or her designee, shall demand proof of inspection of each vehicle presented by any person who wishes to employ such vehicle in a solid waste enterprise and shall determine whether such vehicle meets the minimum standards required in this section. Such proof of inspection shall include inspection of the brakes, lights, turn signals, steering, horns and warning devices, glass, mirrors, exhaust systems, windshield wipers, tires, solid waste container apparatus and such other items of equipment as the Director of Public Service, or his or her designee, may determine to be necessary in order to effectively ensure compliance with this chapter.
   (c)   The Director of Public Service, upon the showing of satisfactory inspection as set forth herein which establishes that a vehicle meets the minimum standards of this section, shall issue a decal or other method of identification as he or she may deem to be appropriate, without which no vehicle may be used in the operation of a solid waste enterprise. Such decal or other method of identification shall be affixed to the inspected vehicle in a uniform location so that such vehicle can be readily identified as having been inspected. Such decal or other method of identification shall not be transferable from the vehicle to which it was originally issued and shall expire on December 31 of the year of issuance.
   (d)   Each vehicle requiring an inspection under this section shall be inspected annually and at any other reasonable time to determine whether or not such vehicle remains in compliance with the provisions of this section. Any vehicle which, for want of repair, because of deterioration or for any other reason, lapses into a condition which renders it incapable of meeting the minimum standards of this section shall immediately be removed from operation until such defect or condition has been corrected, repaired or otherwise neutralized so that the vehicle is once again in compliance with this section.
