1860.06 REGISTRATION OF SOLID WASTE ENTERPRISES.
   (a)   No person shall operate a solid waste enterprise, either wholly or partially, in the City, unless he or she possesses a valid registration certificate issued by the Director of Public Service.
   (b)   Any person who intends to operate a solid waste enterprise in the City, either wholly or partially, shall make written application for a registration certificate to the Director on such a form as is provided by the Director. Such application shall contain such information as the Director determines will reasonably aid in the administration and enforcement of this chapter. Each application for registration shall be accompanied by a fee of twenty-five dollars ($25.00) which shall be used for the purpose of deferring costs of the administration of this chapter.
   (c)   The Director shall issue a registration certificate to operate a solid waste enterprise to only those persons demonstrating the availability of equipment and personnel sufficient to operate a solid waste enterprise in accordance with this chapter, and such registration certificates shall be issued to only those persons agreeing to comply with all conditions of issuance or possession thereof and to otherwise comply with the requirements of this chapter.
   (d)   Upon approval of an application for the issuance of a registration certificate, the Director may state on the registration certificate, or by a written attachment, those conditions under which the certificate is issued to ensure the proper operation of the solid waste enterprise for which such certificate is issued.
   (e)   A registration certificate issued under this section shall expire on December 31 of the year of issuance, unless such certificate is sooner suspended or revoked. Separate registration certificates shall be required for each year or part thereof during which the solid waste enterprise operates. "Year," for the purpose of the registration requirements of this chapter, shall commence on January 1 and end on December 31.
   (f)   No registration certificate shall be transferable from one person to another, although a person holding a registration certificate may transfer the solid waste enterprise from one location to another so long as his or her solid waste enterprise is in full compliance with all of the requirements of this chapter.
   (g)   Before any registration certificate is issued, re-issued or renewed under this section, the applicant shall deposit with the Director of Public Service an insurance policy or certificate of insurance which shall provide for public liability, death, personal injury and property damage coverage in minimum amounts of two hundred fifty thousand dollars ($250,000.00) for each person for bodily injury; five hundred thousand dollars ($500,000.00) for each liability incident; and three hundred thousand dollars ($300,000.00) for each incident involving damage to real or personal property.
   (h)   Before any registration certificate is issued, re-issued or renewed under this section, the applicant shall deposit with the Director of Public Service satisfactory evidence establishing that all employees of the solid waste enterprise are subject to coverage pursuant to Ohio’s Workers Compensation Law.
   (i)   Before any registration certificate is issued, re-issued or renewed under this section, the applicant shall provide proof that such applicant offers optional recyclable collection service along with separate recyclable refuse containers to each residence serviced or thereafter to be serviced by such applicant and satisfactory proof of the applicant’s ability to dispose of such recyclables pursuant to the guidelines for recyclable disposal issued by the applicable solid waste district.
