1860.04 DISPOSAL OF SOLID WASTE.
   (a)   Each person, who is an owner, tenant, lessor, lessee, seller or purchaser under a land sale contract, manager or a person otherwise in a position to exercise control over any real property, including improvements thereon, is responsible for the proper disposal of all solid wastes generated upon such premises to which he or she bears any one or more of such relationships. In fulfilling the requirements imposed by this chapter, each such person shall:
      (1)   Take every reasonable action necessary to properly prepare solid waste on each premises for which he or she is responsible for the safe and sanitary removal, transfer and disposal of such solid waste;
      (2)   Remove and dispose of, or arrange for the removal and disposal of, all nonputrescible solid waste from each premises for which he or she is responsible, through a registered transfer station or solid waste disposal facility, not less frequently than once during each seven consecutive calendar day period;
      (3)   Remove and dispose of, or arrange for the removal and disposal of, all putrescible solid waste from each premises for which he or she is responsible, through a registered transfer station or solid waste disposal facility, not less frequently than is necessary to prevent odor which is offensive to humans and which attracts insects, rodents and other pests around or about such solid waste. In no event shall putrescible solid waste be disposed of as required in this paragraph less frequently than once during each seven consecutive calendar day period.
      (4)   Remove and dispose of, or arrange for the removal and disposal of, any solid waste determined by the Director of the Ohio Department of Health, the Health Commissioner, or its equivalent, in the Combined General Health District of Licking County, Ohio or the Director of Public Service to be hazardous waste or a public nuisance. The removal of solid waste so determined to be hazardous waste or a public nuisance shall be done in accordance with any written or verbal directive of the Director of the Ohio Department of Health, the Health Commissioner, or its equivalent, in the Combined General Health District of Licking County, Ohio or the Director of Public Service, and within any time limit specified therein.
   (b)   No person shall haul or otherwise transport any solid waste, unless the vehicle or container in which such solid waste is being hauled or otherwise transported is securely covered with a tarpaulin or is otherwise constructed or arranged to prevent the contents from being blown from the vehicle or container, and is, in addition, designed, constructed or adopted to prevent the contents thereof from leaking, dropping, sifting or otherwise escaping therefrom.
   (c)   No person who hauls or otherwise transports any solid waste which blows from, leaks, drops, sifts or otherwise escapes from the vehicle or container in which it is being hauled or otherwise transported, while upon any real property, public or private, other than his or her own, shall fail to immediately retrieve, collect, pick up, remove and properly dispose of any such solid waste which so escapes from the vehicle or container. No such person shall fail to immediately remove, flush away and otherwise clean up and dispose of any liquid or other residue which may be incident to or generated by the solid waste and which leaks, sifts, drops or otherwise escapes from a vehicle or container.
