1068.06 PERMITS FOR SPECIAL EVENTS.
   Permits for special events in parks and recreation areas shall be obtained by application to the Superintendent of Parks and Recreation in accordance with the following procedures:
   (a)   A person seeking issuance of a permit under this section shall file an application stating: (1) The name and address of the applicant; (2) The name and address of the person sponsoring the activity, if any; (3) The day and hours for which the permit is desired; (4) The park, or portion thereof, for which the permit is desired; (5) Any other information reasonably necessary to a determination as to whether or not a permit should be issued under this section; and (6) Variances required from park rules and regulations.
   (b)   Standards for issuance of a use permit shall include the following findings: (1) The proposed activity or use of the park will not unreasonably interfere with or detract from the general public's enjoyment of the park. (2) The proposed activity or use will not unreasonably interfere with or detract from the promotion of the public health, welfare, safety or recreation. (3) The proposed activity or use that is reasonably anticipated will not include violence, crime or disorderly conduct. (4) The proposed activity will not entail extraordinary or burdensome expense or police operation by the City. (5) The facilities desired have not been reserved for another use on the date requested in the application.
   (c)   Within ten days after the receipt of an application, the Superintendent shall inform the applicant of his or her decision to grant or deny a permit. Any person aggrieved by the decision of the Superintendent to deny or to grant the issuance of a permit may appeal to Council by serving written notice thereof on the Clerk of Council within five working days of such decision. Council shall decide within ten days from the receipt of the appeal by the Clerk, or at its first meeting after the appeal is filed with the Clerk, whichever is later. The decision of Council shall be final.
   (d)   A permittee shall be bound by all park rules and regulations and other applicable ordinances as fully as though the same were inserted in the permit.
