In addition to the civil penalties provided in Section 1040.43, and not in limitation thereof, whoever violates any provision of this chapter or any order issued by the Director of Public Service, the Ohio Environmental Protection Agency or the United States Environmental Protection Agency, is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both. In the case of organizational culpability, the organization shall be fined not more than five thousand dollars ($5,000) for each offense.
