636.025 EXPOSING A SAFETY OFFICER TO BODILY FLUIDS.
   (a)   No person shall recklessly spit, expel, throw, wipe or blow any bodily fluid or mucous or any object containing or contaminated with any bodily fluid or mucous at or onto a safety officer who is engaged in the performance of their duty, or in anticipation of or response to the performance of their duty.
   (b)   Whoever violates this section is guilty of exposing a safety officer to bodily fluids, which is a misdemeanor of the first degree. Punishment shall be in accordance with section 698.02 of these Codified Ordinances. If physical harm occurs, the offense may increase to a felony and shall be prosecuted pursuant to Ohio R.C. 2903.13 or other relevant sections of the Ohio Revised Code.
   (c)   In this section “safety officer” is defined to include; law enforcement officer, fire-fighter, fire-fighter/paramedic, parking enforcement attendant, animal control officer.
