(a) It shall be unlawful for any person to operate on any street or highway within the limits of the City any vehicle equipped with an engine compression brake or device that is not equipped with a muffler in good working order so as to prevent excessive noise when employed.
(b) Whoever violates the provisions of division (a) of this section is guilty of an unclassified misdemeanor and upon conviction shall be fined not more than one thousand dollars ($1,000).
(c) Notwithstanding any other provision of the Ohio Revised Code or of the codified ordinances of the City that specifies a procedure for the distribution of fines, one-third of all fines collected pursuant to this section shall be returned or credited to the City Division of Police to offset operating expenses.
