69.14   SNOW EMERGENCY. 
   A snow emergency shall be in force for the purpose of implementing procedures pertaining to the location, citing, or removal of vehicles parked on City streets and parking lots that would otherwise impede the progress of snow removal within the City.
      1.   Definition.  A snow emergency is defined as any accumulation of snow one (1) inch or more; it shall not require a public declaration or announcement by the City.
      2.   Notifications.  Signs shall be erected at the main entrances to the City and entrances to all city parking lots notifying the public that parking restrictions are in effect between October 1 and May 31. This may also be posted on the city social media page and posted on the city website during the months of October through May.
      3.   All Parking Prohibited.  During the time that a snow emergency is in force, no person shall park, abandon or leave unattended any vehicle on any public street, alley, or City-owned off-street parking area from the time there has been an accumulation of one (1) inch of snow until 48 hours have passed or the snow has ceased to fall and has been removed or plowed from the street, alley or parking area.
      4.   Duty to Remove.  During the time that a snow emergency is in force, it shall be the duty of all persons who are the registered owners of vehicles parked on the City streets or in City parking lots, as well as the duty of any person who has parked a vehicle on a City street or in a City parking lot, to immediately remove such vehicle from the street or parking lot within one-half hour from the time that the snow emergency becomes effective.  For purposes of this section, the phrase "vehicle parked on a City street or in a City parking lot" or similar words includes vehicles that have become stuck, snowbound or otherwise disabled on any public streets or parking lots.
      5.   Issuance of Parking Citation Issuance and Towing of Improperly Parked Vehicles.  Vehicles found to be parked in violation of this section may be cited for the violation and, to obviate the safety hazards occasioned by incomplete snow removal, be summarily towed on orders of a police officer to some location where the vehicle may be lawfully parked or to the towing firm's vehicle storage lot.  All costs of such towing, parking citation, and any subsequent storage shall be assessed against and paid by the operator or registered owner of the vehicle.  The officer ordering the towing shall keep a record of each vehicle towed, the place where it was taken and by whom.  Such action by the City shall not excuse the owner or operator of the towed vehicle from any of the provisions of subsections 3 and 4 hereof.
      6.   Redemption of Vehicles.  In the event a vehicle is impounded, it may be reclaimed by the registered owner or lien holder of record by payment of the parking citation as well as of all towing and any subsequent storage costs within ten (10) days of the initial impoundment.  If not reclaimed within the initial ten (10) days, the provisions of Chapter 80 of the City Code shall govern the redemption of the vehicle.  In the event a vehicle is moved to another location pursuant to subsection 4 above, the registered owner of the vehicle shall be liable to the City for the reasonable expenses incurred in towing and relocating the vehicle and shall pay the same to the City within fifteen (15) days after a statement from the City is mailed to the registered owner at the address on the current registration form as shown on the records of the County Treasurer.

69.15   PARKING ON PRIVATE PROPERTY PROHIBITED.
   It is unlawful for any person to park a vehicle on land owned or controlled by another without that person’s invitation or consent.  Any vehicle parked on private property in violation of this section may be removed by the owner or person in control of the land upon which the vehicle is improperly parked.  The owner or driver of the improperly parked vehicle shall be liable for all towing and storage charges incurred in removing the vehicle.  The owner or person in control of the land shall not be liable to the owner or driver of the motor vehicle for any damages arising out of such removal provided the owner or person in control of the land complies with the following:
      1.   Has posted in a conspicuous location visible to the driver of the offending vehicle, a sign which states “Private Property, No Parking.  Violators Will be Towed at Owner’s Expense” or words of like effect;
      2.   Exercises ordinary care in the removal of the offending vehicle; and
      3.   Notifies the Police Department of the removal as soon as the same has been accomplished.
69.16   SPECIAL PERMIT PARKING. 
   In order to accommodate the special needs of certain residents of the City, the marked parking stalls located in the City parking lot at Fifth (5th) Street and K Avenue are hereby designated as a “Permit Parking Only” parking area.  Vehicles not displaying valid permits are prohibited from parking in these stalls at any time.  Vehicles displaying valid permits shall not be prohibited from parking in the remainder of the lot; however, the provisions of subsection 3 of this section do not apply when permit vehicles are parked in areas other than the marked parking stalls.
      1.   Application for Permit.  Any resident of the City may apply to the Police Chief for a special permit parking tag which, if issued by the Chief, shall be displayed on a hanging device from the inside rear view mirror at all times when the vehicle is parked in the special permit area.  The applicant shall complete a written application form provided by the Police Department, which application shall state the name, address, home and business phone numbers or business name and address of the owner of the vehicle, the vehicle’s factory VIN number, the current plate and registration number and the make, model, year and color of the vehicle.  The application shall be accompanied by certified funds payable to the “City of Nevada” in the amount of one hundred twenty dollars ($120.00) and by a signed Waiver and Release releasing the City of Nevada from any and all liability arising out of the City’s failure to properly maintain the marked parking stalls, including but not limited to snow and ice removal.
      2.   Permit.  The annual permit shall be valid from September 1 through August 31 of each year.  Permits shall be transferable from one vehicle to another, provided the owner provides the Police Department with the required information pertaining to the replacement vehicle.  Permits are not transferable from one owner to another.  The Police Chief shall have the authority to cancel any permit for any reason upon ten (10) days’ written notice to the owner, served by ordinary first class mail and by posting a copy of the notice on the vehicle, under the driver’s windshield wiper if the vehicle can be located on the lot.  In the event the permit is cancelled by the Chief, the City shall refund the unused portion of the permit to the owner on a pro rata basis, computed on a monthly basis of ten dollars ($10.00) per month or any portion thereof.
      3.   Exemptions.  The owners of vehicles that are properly parked in marked parking stalls of the lot and which display a valid permit shall be exempt from the application and enforcement of Sections 69.13 and 69.14 of this chapter.  All other laws and regulations shall apply to the vehicle.
      4.   No City Maintenance.  The City is relieved of the responsibility for maintaining the marked parking stalls in the lot, including responsibility for ice and snow removal which shall be the responsibility of the individual permit holders.  The City may provide some limited maintenance to the parking stalls to maintain the condition of the lot when vehicles are not parked in the marked parking stalls.
      5.   Signs.  The City shall install no less than two (2) signs facing the designated and marked stalls which shall be plainly visible and which shall read “Permit Parking Between Signs Only” or a similar message.
69.17   FIRE LANES. 
   The Fire Chief and Police Chief shall designate fire lanes on private property where deemed appropriate, and no vehicle shall be left standing or parked with such lanes.
69.18   PASSENGER LOADING AND UNLOADING ZONES.
      1.   The City Council is hereby authorized to determine the location of passenger loading and unloading zones and, upon approval of Council, the City Administrator, or their designee, shall place and maintain appropriate signs and markings indicating the same and stating the hours during which the provisions of this section are applicable.
      2.   When signs and/or road markings are erected giving notice thereof, no person shall park any vehicle for other than the expeditious loading or unloading school passengers at any time during the hours as designated by the signage.
