Property which is no longer vacant shall be removed from the vacant property registration data base. The owner shall notify the program administrator that the vacancy has ended and arrange an inspection of the property by the program administrator or his or her designee.

If a property owner receives notice that the owner's residence of commercial property is considered vacant by the program administrator and disputes the determination but the program administrator uphold his or her decision, the owner shall have the right to appeal such determination following a public hearing before the Village Board of Trustees. If disputed, before a final determination is made by the program administrator, a notice of a right to appeal to the Village Board shall be sent by certified mail to the registered owner at the address maintained in the register of deeds' office at least ten days prior to the program administrator advising of any adverse decision.

The program administrator or his or her designee shall have the right to inspect the interior and exterior of any vacant property upon registration and at one-year intervals thereafter for so long as the property remains on the vacant property registration data base.

(A) Any owner of a vacant property who had not registered a vacant property in compliance with this Vacant Property Registration Act shall be subject to citation and subsequent fine up to $500.
(B) The village may enforce collection of vacant property registration fees by civil action in any court of competent jurisdiction. Unpaid vacant property registration fees and unpaid fines for any violation of a vacant property registration ordinance shall become a lien on the applicable property upon the recording of a notice of such lien in the office of the Cass County, Nebraska Register of Deeds. The lien created under this subsection shall be subordinate to all liens on the applicable property recorded prior to the time the notice of such lien is recorded.
