For purposes of this subchapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
COMMERCIAL BUILDING. A building with more than 50% of its floor space used for purposes other than residential.
DANGEROUS BUILDING. A building that has structural conditions which pose a potential safety hazard to persons or property, and which shall include, but not be limited to, a building:
(1) That is in danger of partial or complete collapse;
(2) That has exterior components that are loose or in danger of falling;
(3) With any components, such as floors, porches, railings, stairs, ramps, balconies, or roofs that are accessible and either have collapsed or are in danger of collapsing, or which are unable to support the weight it is intended to support; and
(4) That is in whole or in part open to entry by animals or unauthorized persons without the use of tools, except for those buildings under construction pursuant to a valid building permit issued by the village.
EVIDENCE OF VACANCY. Any condition or circumstance that on its own or in combination with other conditions or circumstances would lead a reasonable person to believe that a residential building or commercial building is vacant. Such conditions or circumstances may include, but are not limited to:
(1) Overgrown or dead vegetation, including grass, shrubbery, and other plantings;
(2) An accumulation of abandoned personal property, trash, or other waste;
(3) Visible deterioration or lack of maintenance of any building or structure on the property;
(4) Graffiti or other defacement of any building or structure on the property; or
(5) Any other condition or circumstance reasonably indicating that the property is not occupied for residential purposes or being used for the operation of a lawful business.
MUNICIPALITY. A village.
OWNER. The person or persons shown to be the owner or owners of record on the records of the register of deeds, the holder or an unrecorded contract for deed, receiver, personal representative or trustee.
RESIDENTIAL BUILDING. A house, a condominium, a townhouse, an apartment unit or building, or a trailer house.
SECURED BY OTHER THAN NORMAL MEANS. A building secured by means other than those used in the design of the building.
UNOCCUPIED BUILDING. A building which is not being used for a legal occupancy. The storage of products and materials does not constitute occupancy unless authorized by the village's zoning ordinances.
UNSECURED. A building or portion of a building that is open to entry by unauthorized persons without the use of tools, or entry by animals.
VACANT. That a residential building or commercial building exhibits evidence of vacancy and being unoccupied. Vacant excludes properties for which a valid building permit has been issued by the village.
