It shall be unlawful for any person to willfully or carelessly break, injure or deface any building, machinery, apparatus, fixture, attachment or appurtenance of the municipal electrical system.

Any consumer feeling himself or herself aggrieved by reason of any controversy with the Utilities Superintendent may appear before the governing body and present his or her grievance. Any consumer who considers himself or herself aggrieved by being required to pay the charge demanded for the use of electricity, or for the resumption of electric service after the same shall have been shut off, shall pay such charge under protest, in which event, the Municipal Clerk-Treasurer shall write on the receipt given to such customer the words “Paid Under Protest.” Such consumer may then present his or her verified claim in the manner provided for presenting claims to the governing body for a refund of the amount so paid under protest. Such claims shall then be considered by the governing body in the same manner as other claims against the municipality.

Standby generators for temporary or emergency electric service may be connected to the village electrical system, provided, however, that in no event shall any electric generating equipment be connected to the village electric system without written consent granted by the Village Utilities Superintendent upon written request fully describing the service requested to be so connected and fully describing the safeguards proposed to guarantee that the requested connection cannot result in a connection which may operate parallel to the village electrical system. In no event shall any electric generating equipment be connected in parallel to the village electrical system if such connection has the potential to be connected in parallel to the village system without a manual or automatic transfer switch, which shall be installed at the customer’s expense. Any such transfer switch shall be designed so that under no conditions will the connection to the village electrical system operate parallel. Such connection must have a positive break-before-make design. The switch should also incorporate a visual break or some means of determining the physical position of the switch without removing a cover. The switch shall be installed in compliance with this chapter and the National Electric Code, latest edition. In the event an unauthorized connection to the village electrical system is made without proper approval by the village, service will be disconnected immediately until such time as the requirements of this chapter are satisfied.
