No person shall cause or allow earth-disturbing activities on a development area except in compliance with the criteria established by this Chapter as follows:
(a) Erosion and Sedimentation Control (Control During Construction) / Stormwater Pollution Prevention Plans (SWP3).
(1) A SWP3 shall be developed and implemented and an application shall be completed for all projects disturbing one (1) acre or more of land area and on which any regulated activity as described in Section 920.04 is proposed. This includes completion of an application and fee payment.
(2) The following activities shall be permitted to prepare an Abbreviated Stormwater Pollution Prevention Plan as well as an application/fee in lieu of a full SWP3:
A. New single-family residential construction or additions to existing single-family residential construction disturbing greater than 20,000 square feet in land area. If such activities disturb one (1) acre or more, or are part of a larger common plan of development or sale disturbing one (1) acre or more, compliance with the Ohio EPA Construction Site General Permit and a full SWP3 is required.
B. Additions or accessory buildings for single-family residential construction disturbing greater than 20,000 square feet in land area. If such activities disturb one (1) acre or more, or are part of a larger common plan of development or sale disturbing one (1) acre or more, compliance with the Ohio EPA Construction Site General Permit and a full SWP3 is required.
C. All non-residential construction disturbing less than one (1) acre.
D. General clearing activities not related to construction and regardless of parcel size. If such activities disturb one (1) acre or more, or are part of a larger common plan of development or sale disturbing one (1) acre or more, compliance with the Ohio EPA Construction Site General Permit and a full SWP3 is required.
(3) Activities disturbing 20,000 square feet or less are not required to submit a SWP3 or an Abbreviated SWP3, unless required by the City Engineer. However, these activities must comply with all other provisions of this Chapter and will require completion of an agreement form with the City to ensure that the applicable regulations are understood.
(b) Stormwater Management Plan (Control after Construction is Completed).
(1) A Stormwater Management Plan shall be developed and implemented for soil disturbing activities disturbing one (1) or more acres of total land, or less than one (1) acre if part of a larger common plan of development or sale disturbing one (1) or more acres of total land, and on which any regulated activity under Section 920.04 is proposed.
(2) The City of Mount Vernon shall administer this Chapter, and shall be responsible for determination of compliance therewith, and shall issue notices and orders as may be necessary. The City may consult with the Knox County Soil and Water Conservation District, private consultants, stormwater districts, or other technical experts in reviewing the Stormwater Management Plan.
(3) This Chapter shall apply to all parcels used or being developed, either wholly or partially, whether for new or relocated projects, within the scope of Section 920.04.
(4) This regulation does not require a Stormwater Management Plan for linear construction projects, such as pipeline or utility line installation, that do not result in the installation of impervious surface as determined by the City Engineer. Such projects must be designed to minimize the number of stream crossings and the width of disturbance. Linear construction projects must comply with the requirements of Sections 920.15, 920.16, 920.17 and 920.18.
(5) Public entities, including the State of Ohio, Knox County, and the City of Mount Vernon shall comply with this regulation for roadway projects.
(6) Exceptions: Any projects within subdivisions or master developments which are already covered by approved Stormwater Management Plans do not require an individual Stormwater Management Plan unless the construction plan proposes to modify the previously approved stormwater management system or directly affects a public waterway. However, a full SWP3 or abbreviated SWP3 may be required pursuant to this Section.
