4-11-5: COMPLIANCE AND REVOCATION OF VENDING PRIVILEGES:
Any public safety officer, City licensing officer, or other City staff member authorized by the Mayor is authorized to enforce this chapter. Noncompliance of the rules and operations as established by this title will result in the inception of the "Three Strikes", which includes:
   A.   The first act of noncompliance by a mobile food concessions operator will be met with a written warning informing the operator of the noncompliance. The act of noncompliance must be resolved within twenty four (24) hours or subsection 4-11-5B of this title will be administered.
   B.   The second act of noncompliance by a mobile food concessions operator will be met with a five hundred dollar ($500.00) fine.
   C.   The third act of noncompliance will be met with the revocation of mobile food concessions vending privileges for a period no less than three hundred sixty five (365) consecutive days.
      1.   A revocation of vending privileges shall become final within ten (10) days of service unless the mobile food concessions operator appeals the action to the City Council. The mobile food concessions operator shall make their appeal in writing to the City Council within ten (10) days of receipt of the notice.
      2.   Should the applicant or licensee request an appeal within such ten (10) day period, the mobile food concessions operator shall be notified in writing by the City Clerk of the time and place of the public meeting where the appeal will be heard. Should an emergency exist that constitutes an immediate danger to life or health, vending privileges may be summarily revoked pending the notice and public meeting herein provided.
