1109.01 PURPOSE AND APPLICABILITY.
   (a)    The purpose of this article is to provide additional and alternative methods and processes to enforce the municipal code provisions regarding exterior sanitation, common nuisances Zoning violations, and Floodplain violations. related to property located within the City in a fair, speedy and inexpensive manner, and to improve compliance with such provisions.
   (b)    This article shall be in addition to those methods and processes otherwise contained in the Municipal Code of the City of Moundsville and shall be applied at the discretion of the enforcement official enforcing the provisions of this section.
   (c)    In addition to addressing exterior sanitation, common nuisances Zoning violations, and Floodplain violations, this section shall apply to matters contained in the Building Code, and other city laws, incorporated by reference into various Chapters of the Municipal Code of the City of Moundsville, including, but not limited to, the International Property Maintenance Code (IPMC) as follows:
      (1)    Sanitation (IPMC 302.1 or any corresponding section to the extent amended);
      (2)    Drainage (IPMC 302.2 or any corresponding section to the extent amended);
      (3)    Sidewalks in disrepair (IPMC 302.3 or any corresponding section to the extent amended; Section 149.01(d); Section 901.03; 901.16; 1103.02(d)(7));
      (4)    High weeds/grass (IPMC 302.4 or any corresponding section to the extent amended) and (City Code section 907.03);
      (5)    Graffiti (IPMC 302.9 or any corresponding section to the extent amended) and (City Code Section 1111.01 et seq. or any corresponding section to the extent amended);
      (6)    Exterior garbage accumulation (IPMC 307.1 or any corresponding section to the extent amended) and (City Code Section 1103.02(b)(3) or any corresponding section to the extent amended);
      (7)    Open storage and other public nuisances (City Code Section 1103.01 et seq., or any corresponding section to the extent amended);
      (8)    Abandoned vehicles (City Code Section 519.01 et seq. or any corresponding section to the extent amended).
      (9)    Dilapidated Buildings and other building violations and nuisances (City Code Section 1105.01 et seq. or any corresponding section to the extent amended).
      (10)   Zoning Including the Supplemental Regulations (City Code Section 1362 et seq. or any corresponding section to the extent amended).

         E.   Height exceptions.
         F.   Lot lines and irregular lots.
         G.   Swimming pools.

         K.   Clear sight triangle.
         L.   Parking.
         M.   Off street loading space and facilities requirements.
         N.   Storage, general.
         O.   Storage of trailers, camping and recreational equipment.
         P.   Satellite signal receiving stations.
         Q.   Additional restricted use zone established prohibiting drilling into or extraction of ground water.
         R.   Telecommunication facilities.
         S.   Wind energy systems.
         T.   Temporary uses.
         U.   Adult business.
         V.   Bed and breakfast inn.
         W.   Cemetery/mausoleum.
         X.   Child day care facility.
         Y.   Dog day care.
         Z.   Garage sales.
         AA.   Home-based business (Low-Impact).
         BB.   Night clubs, taverns, brewery pubs.

      (11)    Flood Control Regulations, as follows:
         A.   1755.04 Utilization of the floodplain area.
         B.   1755.05 Criteria for building and site plan approval.
         C.   1755.06 Specific requirements.
         D.   Any and all planning, zoning, building, and law enforcement officers shall have authority to enforce the provisions of this article and shall be referred to herein collectively as "enforcement officials.” (Passed 8-4-20.)
