(a) Paving or Repair Order. Whenever Council shall require the owner of any sidewalk, or of the real property next adjacent thereto or adjacent to a street, alley or highway not having a sidewalk, to pave, repair, or install such sidewalk, it shall cause an order to be entered in the records and a copy thereof served upon such owner or his agent or the occupant of such property requiring such person to pave the sidewalk in the manner prescribed in this section within twenty days after the service of such copy.
(b) Failure to Pave or Repair. If the owner, agent, or occupant shall not make the required paving, repairs, replacement, or installation within the time limit as set forth in such notice, the owner or agent may be prosecuted in City Court and assessed a fine for each day past the time limit that he or she is not in compliance. The City shall not be required to pave or make repairs to any sidewalk, and shall not be liable for any injury for failure to do so or failure to enforce this ordinance. However, should the property owner refuse to fail to make a repair after order to do so, the City may undertake repair of the same, at its discretion. The City may cause such repairs to be made upon the most reasonable terms, either by the City or by private contractor and under the direction of the Commissioner of Public Works. The Commissioner shall furnish and file with the City Clerk a correct account containing a statement of the expenses of such repairs, and shall add thereto an additional ten percent (10%) to cover City administrative expenses regarding the matter. Thereupon, Council shall assess the amount of such expense upon the owner of such property and require it to be collected in the manner required by law for the collection of taxes.
(c) Specifications. All sidewalks shall be constructed of concrete or such other suitable material as the City Engineer shall determine, and all sidewalks shall be constructed according to the specifications of the City Engineer and at the grade as established by the City Engineer. All sidewalks, after installed, shall be maintained in good repair by the property owner so as to keep the same free from cracks, deterioration, upheaval, and sinkage, whether due to natural causes, such as tree roots or otherwise. Such property owner shall be responsible for maintaining a level surface sidewalk, and shall remove and repair any section of sidewalk not in compliance herewith at the property owner’s expense. (d) Removal. Property owners of a residence, but not a business, may request that the Street Department remove an existing sidewalk of the property owner which is adjacent to a city street, to assist with the owner's repair or replacement thereof. The property owner shall replace the sidewalk at said owner's expense, within thirty (30) days of such removal, unless such time is extended by the Commissioner of Public Works. However, any such removal shall be at the convenience of the Street Department, and such removal shall only be made once the property owner has contracted with an installer to replace the same, or has provided verification to the Street Department that the property owner will promptly replace said sidewalk.
