(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) (1) Violations of § 92.03 of this code shall be cited into the Town Court as a violation of an ordinance of the town. Each use of a public hydrant without the permission of the town’s Fire Department shall be considered a separate violation.
(2) The penalty for violation of § 92.03 of this code shall be a fine of not less than $25 nor more than $1,000 along with any damages to the hydrant, cost of water and any court costs.
(C) (1) All violations of § 92.04 of this code shall be cited into the Town Court by written citation issued by the Fire Department through its Fire Inspector.
(2) Fines for violation of § 92.04 of this code shall be not less than $50 nor more than $500 for each offense cited. The amount of the fine shall be based upon the severity of the offense and whether or not this is a first offense or there have been prior offenses.
(D) Violation of § 92.16 of this code is hereby declared to be punishable by a fine of not less than $5 nor more than $200. Each violation shall be deemed to be a separate offense. Actual damages along with the fine and court costs may be assessed for violations under § 92.16(D) of this code when the town property has been so damaged and the actual damages are itemized to the Town Court.
(E) If any person, firm or corporation shall violate any of the provisions of §§ 92.30 through 92.35 of this code, or shall do any act prohibited herein, or shall fail to perform any duty lawfully enjoined, within the time prescribed by the Fire Chief or designated deputy, or shall fail, neglect or refuse to obey any lawful order given by the Fire Chief or designated deputy in connection with the provisions of §§ 92.30 through 92.35 of this code for each such violation, failure or refusal, such person, firm or corporation shall be fined in any sum not less than $10, nor more than $50. Each day of such unlawful activity shall constitute a separate offense.
