§ 70.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   Any person, business, corporation or other legal entity violating any of the provisions of § 70.01 of this code shall be subject to a civil fine in an amount not to exceed $500 per violation. In addition, a violator that damages the town’s property shall be subject to a civil enforcement for all damages which are directly attributable to the violation, along with attorneys’ fees and all other costs of enforcement of this action. Enforcement shall be by the town’s Police Department with all actions filed in the Town Court as violations of § 70.01 of this code, cited on the uniform traffic citation, however, civil enforcement actions for damages shall be in the Circuit or Superior Courts of the county. The Police Department shall also have the right to have any vehicle towed and placed in storage at the owner’s expense for a violation where a vehicle is parked in excess of the commercial purpose on a town street, alley or right-of-way. The minimum fine shall be $100 and shall be applicable to any vehicle with a declared weight of 16,000 pounds or greater. For each increment of 1,000 pounds over and above 16,000 pounds, the fine shall increase $100 with a maximum of $500.
   (C)   Any person who is found to have violated § 70.02 of this code shall be fined in an amount of not less than $5 nor more than $500 as a civil penalty, per violation. The first violation by a person in any calendar year shall be subject to admission of violation and payment of the designated civil penalty through the Ordinance Violations Bureau.
   (D)   Any person, firm or corporation violating § 70.04 of this code shall be guilty of a misdemeanor and upon conviction shall be fined not less than $1 not more than $10 for each and every offense.
   (E)   The owner or driver of any truck found to be in violation of § 70.05 of this code shall be fined not less than $10 nor more than $20 for each offense, and each day’s continuance of such offense shall constitute a separate and additional offense.
   (F)   A violation of § 70.07 of this code is a misdemeanor punishable by fines or not less than $1 or more than $25.
