(a) Where a violation of a section under this Chapter would be a minor misdemeanor, a police officer may issue a parking violation notice on a vehicle parked in violation of such section, in lieu of a minor misdemeanor charge being immediately filed. The notice shall instruct the owner or operator of the vehicle to remit a specified payment to the Montpelier Police Department.
(b) When a parking violation notice has been issued, the owner or operator of the vehicle in violation shall pay the following as penalty and as full satisfaction of such violation:
(4) A fine may be assessed for each individual violation and the parking violation notice may indicate multiple violations.
(c) The owner or operator has 72 hours from the service of the notice (excluding weekends and holidays) to remit the payment to the Montpelier Police Department.
(1) Failing to remit the correct payment within 72 hours shall increase the fine for each violation noted by $5.00.
(2) If payment in full has not been made by the owner or operator within 10 days after the date the parking violation notice was issued, notice shall be sent by certified mail, return receipt requested to the registered owner or operator of the vehicle notifying the owner or operator to pay the original penalty, the late fee(s), and the cost sending such notice.
(3) The notice shall give the registered owner or operator 10 business days to remit the payment in full of the original penalty plus late fees and certified mailing costs to the Montpelier Police Department and shall further notify the owner or operator that failure to do so may result in a minor misdemeanor charge.
(4) A registered owner or operator of a vehicle who receives such notice and fails to pay the specified amount in such notice on or before the due date shall be guilty of a minor misdemeanor and shall be subject to the penalties in Section 303.99.
(5) If the operator of the motor vehicle fails to remit the required payment or the operator of the motor vehicle cannot be readily identified, the registered owner of the vehicle is prima-facie responsible for the violation and remittance of payment. (Ord. 2190. Passed 10-26-15.)
