3-3-6: LICENSE CLASSIFICATIONS; HOURS:
Retail licenses for the sale of alcoholic liquor shall consist of the following classes, with the following hourly restrictions, and shall be issued only after payment in full of the fees enumerated in section 3-3-7 of this chapter: (Ord. 474, 2-8-1978)
   A.   Class A: Class A licenses shall include the sale of alcoholic liquor for consumption on the premises categorized as follows: (Ord. 1702, 11-12-2014)
A-1 License (Bars/Taverns):
A Class A-1 license shall entitle the licensee to make sales of alcoholic liquor from the premises which is primarily used to serve alcoholic liquor and not food sales. (Ord. 1852, 5-23-2018; amd. Ord. 1894, 2-13-2019)
A-1(a) License: A Class A-1(a) license shall entitle the licensee to make sales of alcoholic liquor from the premises which is primarily used to serve alcoholic liquor and not food sales. The license also authorizes the sale of alcoholic liquor in its original package not for consumption on the licensed premises. (Ord. 1892, 1-23-2019; amd. Ord. 1894, 2-13-2019)
The total number of licenses issued for both Class A-1 and A-1(a) shall not exceed five (5) at any one time. (Ord. 1894, 2-13-2019)
A-2 License (Restaurants): A Class A-2 license shall entitle the licensee to make sales of alcoholic liquor from the premises which is primarily used to serve food. No more than six (6) licenses of this class shall be issued and in force at any time.
A-3 License (Banquet Hall): A Class A-3 license shall entitle the licensee to make sales of alcoholic liquor from the premises which is used to serve food for more than one hundred (100) individuals at a time. No more than one license shall be issued and in force at any time.
A-4 License (Gaming Facility): A Class A-4 license shall entitle the licensee to make sales of alcoholic liquor from the premises where video gaming machines are the primary attractions of the facility. No more than one license shall be issued and in force at any time.
A-5 License (Club): A Class A-5 license shall entitle the licensee to make sales of alcoholic liquor from the premises used as a club as defined herein. No more than one license shall be issued and in force at any time.
A-6 License (Special Event): A Class A-6 license shall entitle the licensee to make sales of alcoholic liquor at a special event which is held no more than two (2) times per year and not exceeding six (6) days in duration. No more than two (2) licenses shall be issued and in effect at any time.
   B.   Class B: Class B licenses shall be limited to the sale of only beer and wine for consumption on the premises categorized as follows:
B-1 License (Bars And Taverns):
A Class B-1 license shall entitle the licensee to make sales of beer and wine from the premises which is primarily used to serve beer and wine and not food sales.
B-1(a) License: A Class B-1(a) license shall entitle the licensee to make sales of beer and wine from the premises which is primarily used to serve beer and wine and not food sales. The license also authorizes the sale of beer and wine in its original package not for consumption on the licensed premises.
The total number of licenses issued for both Class B-1 and B-1(a) shall not exceed zero (0) at any one time.
B-2 License (Restaurants): A Class B-2 license shall entitle the licensee to make sales of beer and wine from the premises which is primarily used to serve food. No more than six (6) licenses shall be issued and in force at any time.
B-3 License (Banquet Hall): A Class B-3 license shall entitle the licensee to make sales of beer and wine from the premises which is primarily used to serve food for more than one hundred (100) individuals at a time. No more than one license shall be issued and in force at any time.
B-4 License (Gaming Facility): A Class B-4 license shall entitle the licensee to make sale of beer and wine from the premises where video gaming machines are the primary attractions of the facility. No more than one license shall be issued and in force at any time.
B-5 License (Club): A Class B-5 license shall entitle the licensee to make sale of beer and wine from the premises used as a club as defined herein. No more than one license shall be issued and in force at any time.
B-6 License (Special Event): A Class B-6 license shall entitle the licensee to make sales of beer and wine at a special event which is held no more than two (2) times per year and not exceeding four (4) days in duration. No more than two (2) licenses shall be issued and in effect at any time.
   C.   Class C: Class C licenses shall authorize the retail package sale of all alcoholic liquor on the premises. There shall be no consumption of any alcoholic liquor on the licensed premises. No more than five (5) licenses shall be issued and in effect at any time.
   D.   Class D: Class D licenses shall authorize the retail package sale of only beer and wine on the premises. There shall be no consumption of beer or wine on the licensed premises. No more than five (5) licenses shall be issued and in effect at any time.
   E.   Class E: Class E license shall authorize the retail package sale of all alcoholic liquor and the sale of beer and wine for consumption on the premises only, in conjunction with the use of video gaming machines. Except for the use of the video gaming terminals, no other entertainment on the property shall be permitted. No more than four (4) licenses shall be issued and in effect at one time.
   F.   Hours Of Operation:
      1.   Holders of Class A and Class B liquor licenses are hereby authorized to be open for business and sell at retail alcohol, liquor and/or beer and wine during the following hours:
         a.   Sunday through and including Thursday from seven o'clock (7:00) A.M. until one o'clock (1:00) A.M. the following day.
         b.   Friday and Saturday from seven o'clock (7:00) A.M. until two o'clock (2:00) A.M. the following day.
      2.   Holders of Class C and D licenses are authorized to open for business and sell at retail package alcoholic liquor and/or beer and wine during the following hours:
         a.   Mondays through Saturdays from six thirty o'clock (6:30) A.M. until one o'clock (1:00) A.M. the following day.
