4-4-8: OUT OF TOWN VFH COMPANIES AND TNC DRIVER VEHICLES:
   A.   VFH Company Exemption: A VFH company primarily engaged in business outside of the city is exempt from the provisions of this chapter if the VFH company:
      1.   Is subject to similar regulations in another jurisdiction;
      2.   Conducts business within the city less than ten (10) days per calendar year;
      3.   Provides to the finance officer, prior to providing ride services in the city, a notarized statement of compliance with such jurisdiction's regulations along with a copy of the applicable regulations; and
      4.   Notifies the police department prior to providing ride services on each day ride services will be provided.
   B.   Exemption Non-compliance:
      1.   No VFH company primarily engaged in business outside of the city may provide ride services in the city without meeting the applicable exemption criteria.
      2.   The police department will provide written notice to a VFH company of a violation of this section. A ticket or written warning issued to the VFH driver may serve as such written notice. However, when written notice is provided to a VFH driver, the police department will also provide a copy of such written notice to the VFH company.
      3.   In addition to prosecution for violating this section, a VFH company in violation of this section must not provide ride services in the city for fourteen (14) days.
      4.   Upon expiration of the fourteen (14) days, the VFH company may only resume the provision of ride services if the applicable exemption criteria are satisfied or if a license has been acquired. (Ord. O2019-21, 10-7-2019)
