Every person, including corporations or other organizations, within the City, who is licensed for the sale of alcoholic beverages, on-sale, pursuant to South Dakota Codified Laws 35-4-2 (4), (6), (11), (13) or (16), and who is issued a video lottery establishment license pursuant to South Dakota Codified Laws 42-7A-41, shall pay to the City for the privilege of locating video lottery machines on the licensed premises, an annual additional license fee (in addition to the fees imposed under South Dakota Codified Laws 35-4-2 and 42-7A-41) as established from time to time by resolution of the City Council for each video lottery machine placed or to be placed in or upon the licensed premises at any time during the term of the license. The total additional license fee paid shall represent the maximum number of video lottery machines which may be placed in or upon the licensed premises at any one time during the term of the license. Such fees shall be payable to the Finance Office at the same time and in the same manner as license fees paid pursuant to South Dakota Codified Laws 35-4-2, provided that the fees provided for in this section shall not be imposed on more than one license per location. A. Wine licenses issued with video lottery are limited to those licenses that were issued as of April 1, 2007, or were applied for on or before April 1, 2007; otherwise no wine licenses will be issued with video lottery. Any previously issued wine license that did not request its issuance with video lottery will not be authorized to request video lottery with said license. (Ord. 2239, 6-4-2007)
B. On-off sale malt beverage (RB) licenses issued with video lottery are limited to those licenses that were issued as of April 1, 2018, or were applied for on or before April 1, 2018; otherwise no on-off sale malt beverage (RB) licenses will be issued with video lottery. Any previously issued on-off sale malt beverage (RB) license that did not request its issuance with video lottery will not be authorized to request video lottery with said license. (Ord.
